本商品之疾病等待期間為生效日起持續有效滿三十天以內。
本保險因費率計算考慮脫退率致本險無解約金。

【保險契約的構成】
第 一 條：本台灣人壽LONG好康手術醫療終身保險附約A型（以下簡稱本附約），係依終身保險主契約（
以下簡稱主契約）要保人申請，並經本公司同意，以主契約之被保險人及其配偶、子女為本
附約之被保險人，附加於主契約訂定之。
本附約保險單條款、附著之要保書、批註及其他約定書，均為本附約的構成部分。
本附約的解釋，應探求契約當事人的真意，不得拘泥於所用的文字；如有疑義時，以作有利於

被保險人的解釋為原則。
【名詞定義】
第 二 條：本附約所稱名詞定義如下：
一、本附約所稱「疾病」，係指被保險人自本附約生效日起持續有效滿三十日後或復效日（含
）起所發生之疾病。但如被保險人投保時之保險年齡為零歲者，就中央衛生主管機關公告
認定「新生兒先天性代謝異常疾病篩檢」指定項目之相關疾病，不適用前述自本附約生效
日起需持續有效滿三十日之限制。
二、本附約所稱「傷害」，係指被保險人於本附約有效期間內，遭受意外傷害事故，因而蒙受
之傷害。
三、本附約所稱「意外傷害事故」，係指非由疾病引起之外來突發事故。
四、本附約所稱「醫院」，係指依照醫療法規定領有開業執照並設有病房收治病人之公、私立
及醫療法人醫院。
五、本附約所稱「住院」，係指被保險人經醫師診斷其疾病或傷害必須入住醫院，且正式辦理
住院手續並確實在醫院接受診療者。但不包含全民健康保險法第五十一條所稱之日間住院
及精神衛生法第三十五條所稱之日間留院。
六、本附約所稱「醫師」，係指領有醫師證書而合法執業者，且非要保人、被保險人或受益人
本人。
七、本附約所稱「同一次住院」，係指被保險人於本附約有效期間，因同一疾病或傷害，或因
此引起之併發症，於出院後十四日內於同一醫院再次住院時，其各項保險金給付及其限制
，視為同一次住院辦理，倘被保險人係於本附約有效期間屆滿後出院者，本公司就再次住
院部分不予給付保險金。
八、本附約所稱「診所」，係指依照醫療法規定領有開業執照之診所。
九、本附約所稱「保險金額」，係指本附約生效時保險單面頁上所載之投保金額，如該金額有
所變更時，則以變更後之保險金額為準。
十、本附約所稱「保險年齡」，係指按投保時被保險人以足歲計算之年齡，但未滿一歲的零數
超過六個月者加算一歲，以後每經過一個保單年度加算一歲。
十一、本附約所稱「表定保費」，係指依繳費方法對應附表一所載之保險費率乘以「保險金額
」計算而得之金額。
十二、本附約所稱「所繳保險費」，係指自本附約訂立後至被保險人身故時所繳之表定保費，
惟次標準件採加費方式承保者，依加費後保險費計算。
十三、本附約所稱「繳別保險費」，係指依其繳費方法，於保險事故發生時應繳之表定保費。
十四、本附約所稱「應繳繳別保險費總和」，係以繳別保險費為基礎，乘以保險事故發生時之
繳費方法自本附約訂立後至保險事故發生時累計應繳保險費次數後之金額。
十五、本附約所稱「已領醫療保險金倍數」，係指申領第十三條至第二十條保險金時，其合計
金額除以申領當時「保險金額」之數值。
十六、本附約所稱「累計已領醫療保險金倍數」，係指自本附約生效日起累計之「已領醫療保
險金倍數」之數值。
十七、本附約所稱「健康險部分」，係指第十三條至第二十一條之給付項目。

十八、本附約所稱「已領健康險部分保險金倍數」，係指申領第十三條至第二十一條保險金時
，其合計金額除以申領當時「保險金額」之數值。
十九、本附約所稱「健康險部分累計申領之保險金金額」，係指自本附約生效日起累計之「已
領健康險部分保險金倍數」乘以當時之「保險金額」之數值。
二十、本附約所稱「被保險人」，係指附加本附約之主契約被保險人及其「配偶」、「子女」
。
二十一、本附約所稱「配偶」，係指於本附約訂定時，主契約被保險人戶籍登記之配偶，並應
將其姓名及相關資料載明於契約中。
二十二、本附約所稱「子女」，係指於本附約訂定時，主契約被保險人之未滿二十三歲的親生
子女、養子女，並應將其姓名及相關資料載明於契約中。
【附約撤銷權】
第 三 條：要保人於保險單送達的翌日起算十日內，得以書面或其他約定方式檢同保險單向本公司撤銷本
附約。
要保人依前項規定行使本附約撤銷權者，撤銷的效力應自要保人書面或其他約定方式之意思表
示到達翌日零時起生效，本附約自始無效，本公司應無息退還要保人所繳保險費；本附約撤銷
生效後所發生的保險事故，本公司不負保險責任。但本附約撤銷生效前，若發生保險事故者，
視為未撤銷，本公司仍應依本附約規定負保險責任。
【保險責任的開始及交付保險費】
第 四 條：本附約如係與主契約同時投保，以主契約保險期間之始時為本附約之始時。如係中途申請附加
者，經本公司同意後，以保險單上所約定的日時為準。
本公司應自同意承保並收取第一期保險費後負保險責任，並應發給保險單作為承保的憑證。
本公司如於同意承保前，預收相當於第一期保險費之金額時，其應負之保險責任，以同意承保
時溯自預收相當於第一期保險費金額時開始。
前項情形，在本公司為同意承保與否之意思表示前發生應予給付之保險事故時，本公司仍負保
險責任。
本附約的保險費，應與主契約一併交付。主契約於繳費期滿後，如尚屬有效契約且本附約仍於
繳費期間內時，本附約得按年繳保險費方式，繼續附加於主契約。
【保險範圍】
第 五 條：被保險人於本附約有效期間內身故、因第二條約定之疾病或傷害接受手術治療、放射線診療、
治療處置，或於保險年齡達一○一歲之保單週年日時仍生存者，本公司依本附約約定給付保險
金。
【第二期以後保險費的交付、寬限期間及附約效力的停止】
第 六 條：分期繳納的第二期以後保險費，應照本附約所載交付方法及日期，向本公司所在地或指定地點
交付，或由本公司派員前往收取，並交付本公司開發之憑證。第二期以後分期保險費到期未交
付時，年繳或半年繳者，自催告到達翌日起三十日內為寬限期間；月繳或季繳者，則不另為催

告，自保險單所載交付日期之翌日起三十日為寬限期間。
約定以金融機構轉帳或其他方式交付第二期以後的分期保險費者，本公司於知悉未能依此項約
定受領保險費時，應催告要保人交付保險費，自催告到達翌日起三十日內為寬限期間。
逾寬限期間仍未交付者，本附約自寬限期間終了翌日起停止效力。如在寬限期間內發生保險事
故時，本公司仍負保險責任。
本公司依約定催告要保人交付保險費時，其通知應送達於要保人之最後住所或居所，保險費經
催告後，應於本公司營業所交付之。
【保險費的墊繳及附約效力的停止】
第 七 條：本附約「保險費的墊繳及附約效力的停止」，僅適用附加於主契約保險單條款有「保險費的墊
繳及契約效力的停止」條款之約定者。主契約及本附約保險費，超過主契約寬限期間仍未交付
時，應就主契約保險費與本附約保險費之合計金額準用主契約有關「保險費的墊繳及契約效力
的停止」條款之約定辦理。
【本附約效力的恢復】
第 八 條：本附約停止效力後，要保人得在停效日起二年內，申請復效。但主契約未申請復效者或保險期
間屆滿後，本附約不得申請復效。
要保人於停止效力之日起六個月內提出前項復效申請，並經要保人清償保險費扣除停效期間的
危險保險費後之餘額及按保險費之預定利率計算之利息後，自翌日上午零時起，開始恢復其效
力。
要保人於停止效力之日起六個月後提出第一項之復效申請者，本公司得於要保人之復效申請送
達本公司之日起五日內要求要保人提供被保險人之可保證明。要保人如未於十日內交齊本公司
要求提供之可保證明者，本公司得退回該次復效之申請。
被保險人之危險程度有重大變更已達拒絕承保程度者，本公司得拒絕其復效。
本公司未於第三項約定期限內要求要保人提供可保證明，或於收齊可保證明後十五日內不為拒
絕者，視為同意復效，並經要保人清償第二項所約定之金額後，自翌日上午零時起，開始恢復
其效力。
要保人依第三項提出申請復效者，除有同項後段或第四項之情形外，於交齊可保證明，並清償
第二項所約定之金額後，自翌日上午零時起，開始恢復其效力。
第一項約定期限屆滿時，本附約效力即行終止。
【告知義務與本附約的解除】
第 九 條：要保人或被保險人在訂立本附約時，對於本公司要保書書面詢問的告知事項應據實說明，如有
為隱匿或遺漏不為說明，或為不實的說明，足以變更或減少本公司對於危險的估計者，本公司
得解除本附約，其保險事故發生後亦同。但危險的發生未基於其說明或未說明的事實時，不在
此限。惟屬個別被保險人違反前述告知義務者，本公司得就該被保險人個別部分解除，而不影
響其他被保險人於本附約之效力。
前項解除附約權，自本公司知有解除之原因後，經過一個月不行使而消滅；或自本附約訂立後
，經過二年不行使而消滅。

本公司通知解除本附約時，如要保人身故、失蹤或居住所不明，通知不能送達時，本公司得將
該項通知送達受益人。
【附約的終止】
第 十 條：要保人得隨時終止個別被保險人投保之本附約。
前項附約之終止，自本公司收到要保人書面或其他約定方式通知時，開始生效。
要保人依第一項約定終止本附約時，本公司應從當期已繳保險費扣除按日數比例計算已經過期
間之保險費後，將其未到期保險費退還要保人，但附約繳費期滿者，不在此限。
主契約被保險人身故時，其所附加之本附約的效力即行終止，但其配偶或子女所附加之本附約
不在此限。
個別被保險人所投保之本附約除該被保險人已繳費期滿或已達豁免保險費或因保險事故發生
且於保險給付當中者外，有下列情形之一時，其效力持續至該期已繳之保險費期滿後終止：
一、要保人終止主契約時。
二、主契約變更為展期定期保險時。
主契約辦理減額繳清保險或主契約被保險人因非屬身故之保險事故致主契約終止時，本附約應
依本公司指定之繳費方式繳納其應繳交之保險費，以延續本附約之效力。
【保險事故的通知與保險金的申請時間】
第十一條：要保人或受益人應於知悉本公司應負保險責任之事故後十日內通知本公司，並於通知後儘速檢
具所需文件向本公司申請給付保險金。
本公司應於收齊前項文件後十五日內給付之。但因可歸責於本公司之事由致未在前述約定期限
內為給付者，應按年利一分加計利息給付。
【失蹤處理】
第十二條：被保險人在本附約有效期間內失蹤者，如經法院宣告死亡時，本公司根據判決內所確定死亡時
日為準，依第二十二條約定退還所繳保險費或給付身故保險金或喪葬費用保險金；如要保人或
應得之人或受益人能提出證明文件，足以認為被保險人極可能因意外傷害事故而死亡者，本公
司應依意外傷害事故發生日為準，依第二十二條約定退還所繳保險費或給付身故保險金或喪葬
費用保險金。
前項情形，本公司退還所繳保險費或給付身故保險金或喪葬費用保險金後，如發現被保險人生
還時，要保人或應得之人或受益人應將該筆已領之所繳保險費或身故保險金或喪葬費用保險金
歸還本公司，其間若有應給付保險金之情事發生者，仍應予給付。但有應繳之保險費，本公司
仍得予以扣除。
【手術醫療保險金的給付】
第十三條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受手術治療者，本公司按「保險金額」乘以附表二「手術項目表」中所列該手術項目的
倍數，給付「手術醫療保險金」。
被保險人於門診當天或同一次住院期間接受兩項以上手術時，其各項手術醫療保險金應分別計

算。但同一次手術中，於同一手術位置接受兩項器官以上手術時，僅按較高倍數之手術項目給
付「手術醫療保險金」。
被保險人所接受的手術，若不在附表二「手術項目表」所載項目且非屬第三十條除外責任範圍
內，但屬於事故當時中央衛生主管機關最新公布之「全民健康保險醫療費用支付標準」第二部
第二章第七節所載手術項目時，本公司將比照附表二「手術項目表」內程度相當之手術項目決
定給付倍數，但最高不得超過一百倍。
【住院手術療養保險金的給付】
第十四條：被保險人符合第十三條之約定且實際於住院期間接受手術治療者，另按「保險金額」的三倍，
給付「住院手術療養保險金」。
被保險人於同一次住院期間接受兩項以上手術時，其各項住院手術療養保險金應分別計算。但
同一次手術中，於同一手術位置接受兩項器官以上手術時，僅給付一次「住院手術療養保險金
」。
【重大手術慰問保險金的給付】
第十五條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受附表三「重大手術項目表」中所列重大手術項目之一時，本公司除依第十三條、第十
四條之約定給付各項保險金外，另按「保險金額」乘以附表三「重大手術項目表」中所列該重
大手術項目的倍數，給付「重大手術慰問保險金」。
被保險人於門診當天或同一次住院期間接受兩項以上重大手術時，其各項重大手術慰問保險金
應分別計算。但同一次手術中，於同一手術位置接受兩項器官以上手術時，僅按較高倍數之重
大手術項目給付「重大手術慰問保險金」。
【放射線診療保險金的給付】
第十六條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受放射線診療者，本公司按「保險金額」乘以附表四「放射線診療項目表」中所列該放
射線診療項目的倍數，給付「放射線診療保險金」。若不在附表四上之項目，本公司不負給付
責任。
被保險人於門診當天或同一次住院期間接受兩項以上放射線診療時，其各項放射線診療保險金
應分別計算。但同一次放射線診療中，於同一位置接受兩項器官以上放射線診療時，僅按較高
倍數之放射線診療項目給付「放射線診療保險金」。
【治療處置保險金的給付】
第十七條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受治療處置者，本公司按「保險金額」乘以附表五「治療處置項目表」中所列該治療處
置項目的倍數，給付「治療處置保險金」。若不在附表五上之項目，本公司不負給付責任。
被保險人於門診當天或同一次住院期間接受兩項以上治療處置時，其各項治療處置保險金應分
別計算。但同一次治療處置中，於同一位置接受兩項器官以上治療處置時，僅按較高倍數之治
療處置項目給付「治療處置保險金」。

【人工髖關節醫材購置補助保險金的給付】
第十八條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受人工髖關節置換者，每次置換每側本公司除依第十三條至第十七條之約定給付各項保
險金外，另按「保險金額」的三十倍，給付「人工髖關節醫材購置補助保險金」。
【人工膝關節醫材購置補助保險金的給付】
第十九條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受人工膝關節置換者，每次置換每側本公司除依第十三條至第十七條之約定給付各項保
險金外，另按「保險金額」的三十倍，給付「人工膝關節醫材購置補助保險金」。
【人工水晶體醫材購置補助保險金的給付】
第二十條：被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或
診所接受人工水晶體置換者，每次置換每眼本公司除依第十三條至第十七條之約定給付各項保
險金外，另按「保險金額」的三十倍，給付「人工水晶體醫材購置補助保險金」。
【無理賠增額保險金的給付】
第二十一條：受益人於申領第十三條至第二十條之各項保險金時，如於本次保險事故發生時前二個保單年
度（含）以上，未依第十三條至第二十條之約定申請各項保險金且本附約持續有效時，本公
司除依第十三條至第二十條約定給付各項保險金外，另按第十三條至第二十條各項保險金給
付合計金額乘以下表連續未申請各項保險金保單年度數所對應之增額比率，給付「無理賠增
額保險金」。

【所繳保險費的退還、身故保險金或喪葬費用保險金的給付】
第二十二條：被保險人於本附約有效期間內且年滿十五足歲起，於未達保險年齡十六歲之保單週年日前身
故時，本公司按身故時之所繳保險費給付身故保險金；於達保險年齡十六歲之保單週年日後
身故者，本公司按身故時應繳繳別保險費總和的一點零六倍扣除健康險部分累計申領之保險
金金額給付「身故保險金」。
本公司依約定給付「身故保險金」後，本附約效力即行終止。
如被保險人身故時，其健康險部分累計申領之保險金金額已達應繳繳別保險費總和的一點零
六倍者，本公司不再給付「身故保險金」，本附約效力自被保險人身故時終止。
訂立本附約時，以未滿十五足歲之未成年人為被保險人，其身故保險金之給付於被保險人滿
十五足歲之日起發生效力；被保險人滿十五足歲前身故者，本公司應退還被保險人身故日之

所繳保險費予要保人或應得之人。本公司退還所繳保險費後，本附約效力即行終止。
訂立本附約時，以精神障礙或其他心智缺陷，致不能辨識其行為或欠缺依其辨識而行為之能
力者為被保險人，其身故保險金變更為喪葬費用保險金。
前項被保險人於民國九十九年二月三日（含）以後所投保之喪葬費用保險金額總和（不限本
公司），不得超過訂立本附約時遺產及贈與稅法第十七條有關遺產稅喪葬費扣除額之半數，
其超過部分本公司不負給付責任，本公司並應無息退還該超過部分之已繳保險費。
前項情形，如要保人向二家（含）以上保險公司投保，或向同一保險公司投保數個保險契（
附）約，且其投保之喪葬費用保險金額合計超過前項所定之限額者，本公司於所承保之喪葬
費用金額範圍內，依各要保書所載之要保時間先後，依約給付喪葬費用保險金至前項喪葬費
用額度上限為止，如有二家以上保險公司之保險契約要保時間相同或無法區分其要保時間之
先後者，各該保險公司應依其喪葬費用保險金額與扣除要保時間在先之保險公司應理賠之金
額後所餘之限額比例分擔其責任。
【祝壽保險金的給付】
第二十三條：被保險人於保險年齡達一○一歲之保單週年日時仍生存且本附約仍屬有效者，本公司按應繳
繳別保險費總和的一點零六倍扣除健康險部分累計申領之保險金金額給付「祝壽保險金」。
本公司依前項約定給付「祝壽保險金」後，本附約效力即行終止。
如被保險人於本附約保險期間屆滿時仍生存且本附約仍屬有效時，其健康險部分累計申領之
保險金金額已達應繳繳別保險費總和的一點零六倍者，本公司不再給付「祝壽保險金」，本
附約效力自保險期間屆滿時終止。
【保險金給付的限制】
第二十四條：本公司依本附約第十三條至第二十條給付之保險金，其「累計已領醫療保險金倍數」最高以
一千五百倍為限，當「累計已領醫療保險金倍數」達一千五百倍時，本附約效力即行終止。
【祝壽保險金的申領】
第二十五條：受益人申領「祝壽保險金」時，應檢具下列文件：
一、保險單或其謄本。
二、保險金申請書。
三、受益人的身分證明。
【身故保險金或喪葬費用保險金的申領】
第二十六條：受益人申領「身故保險金」或喪葬費用保險金時，應檢具下列文件：
一、保險單或其謄本。
二、被保險人死亡證明書或相驗屍體證明書，及除戶戶籍謄本。
三、保險金申請書。
四、受益人的身分證明。
【退還所繳保險費的申請】

第二十七條：要保人或應得之人依第十二條、第二十二條或第二十九條約定申請退還所繳保險費時，應檢
具下列文件：
一、保險單或其謄本。
二、被保險人死亡證明書或相驗屍體證明書，及除戶戶籍謄本。
三、申請書。
四、要保人或應得之人的身分證明。
【「健康險部分」保險金的申領】
第二十八條：受益人申領本附約第十三條至第二十一條之「健康險部分」保險金時，應檢具下列文件。
一、保險金申請書。
二、保險單或其謄本。
三、醫療診斷書。
四、申領「手術醫療保險金」、「重大手術慰問保險金」、「人工髖關節醫材購置補助保險
金」、「人工膝關節醫材購置補助保險金」或「人工水晶體醫材購置補助保險金」者，
另需檢具手術證明文件。
五、申領「住院手術療養保險金」者，另需檢具手術證明文件及住院證明。
六、申領「放射線診療保險金」者，另需檢具放射線診療證明文件。
七、申領「治療處置保險金」者，另需檢具治療處置證明文件。
八、受益人的身分證明。
受益人申領保險金時，本公司於必要時得另經其同意調閱被保險人之就醫相關資料，其一切
費用由本公司負擔。但不得因此延展保險公司依第十一條約定應給付之期限。
【身故保險金或喪葬費用保險金之除外責任】
第二十九條：有下列情形之一者，本公司不負給付身故保險金或喪葬費用保險金的責任。
一、要保人故意致被保險人於死。
二、被保險人故意自殺。但自本附約訂立或復效之日起二年後故意自殺致死者，本公司仍負
給付身故保險金或喪葬費用保險金之責任。
三、被保險人因犯罪處死或拒捕或越獄致死。
被保險人滿十五足歲前因第一項各款原因致死者，本公司依第二十二條約定退還所繳保險費
予要保人或應得之人。
【「健康險部分」之除外責任】
第三十條：被保險人因下列原因而接受手術治療、放射線診療或治療處置者，本公司不負給付第十三條至
第二十一條各項保險金的責任。
一、被保險人之故意行為（包括自殺及自殺未遂）。
二、被保險人之犯罪行為。
三、被保險人非法施用防制毒品相關法令所稱之毒品。
被保險人因下列事故而接受手術治療、放射線診療或治療處置者，本公司不負給付第十三條至
第二十一條各項保險金的責任。

一、美容手術、外科整型。但為重建其基本功能所作之必要整型，不在此限。
二、外觀可見之天生畸形。
三、健康檢查、療養、靜養、戒毒、戒酒、護理或養老之非以直接診治病人為目的者。
四、懷孕、流產或分娩及其併發症。但下列情形不在此限：
（一）懷孕相關疾病：
1.子宮外孕。
2.葡萄胎。
3.前置胎盤。
4.胎盤早期剝離。
5.產後大出血。
6.子癲前症。
7.子癇症。
8.萎縮性胚胎。
9.胎兒染色體異常之手術。
（二）因醫療行為所必要之流產，包含：
1.因本人或其配偶患有礙優生之遺傳性、傳染性疾病或精神疾病。
2.因本人或其配偶之四親等以內之血親患有礙優生之遺傳性疾病。
3.有醫學上理由，足以認定懷孕或分娩有招致生命危險或危害身體或精神健康。
4.有醫學上理由，足以認定胎兒有畸型發育之虞。
5.因被強制性交、誘姦或與依法不得結婚者相姦而受孕者。
（三）醫療行為必要之剖腹產，並符合下列情況者：
1.產程遲滯：已進行充足引產，但第一產程之潛伏期過長（經產婦超過14小時、初
產婦超過20小時），或第一產程之活動期子宮口超過2小時仍無進一
步擴張，或第二產程超過2小時胎頭仍無下降。
2.胎兒窘迫，係指下列情形之一者：
a.在子宮無收縮情況下，胎心音圖顯示每分鐘大於160次或少於100次且呈持續性
者，或胎兒心跳低於基礎心跳每分鐘30次且持續60秒以上者。
b.胎兒頭皮酸鹼度檢查PH值少於7.20者。
3.胎頭骨盆不對稱，係指下列情形之一者：
a.胎頭過大（胎兒頭圍37公分以上）。
b.胎兒超音波檢查顯示巨嬰（胎兒體重4000公克以上）。
c.骨盆變形、狹窄（骨盆內口10公分以下或中骨盆9.5公分以下）並經骨盆腔攝
影確定者。
d.骨盆腔腫瘤（包括子宮下段之腫瘤，子宮頸之腫瘤及會引起產道壓迫阻塞之骨
盆腔腫瘤）致影響生產者。
4.胎位不正。
5.多胞胎。
6.子宮頸未全開而有臍帶脫落時。
7.兩次（含）以上的死產（懷孕24周以上，胎兒體重560公克以上）。

8.分娩相關疾病：
a.前置胎盤。
b.子癲前症及子癇症。
c.胎盤早期剝離。
d.早期破水超過24小時合併感染現象。
e.母體心肺疾病：
（a）嚴重心律不整，並附心臟科專科醫師診斷證明或心電圖檢查認定須剖腹
產者。
（b）經心臟科採用之心肺功能分級認定為第三或第四級心臟病，並附診斷證
明。
（c）嚴重肺氣腫，並附胸腔科專科醫師診斷證明。
五、不孕症、人工受孕或非以治療為目的之避孕及絕育手術。
【受益人受益權之喪失】
第三十一條：受益人故意致被保險人於死或雖未致死者，喪失其受益權。
前項情形，如因該受益人喪失受益權，而致無受益人受領保險金額時，其保險金額作為被保
險人遺產。如有其他受益人者，喪失受益權之受益人原應得之部份，按其他受益人原約定比
例分歸其他受益人。
【欠繳保險費的扣除】
第三十二條：本公司給付各項保險金或退還所繳保險費時，如要保人有欠繳保險費，本公司得先抵銷上述
欠款後給付其餘額。
【保險金額之減少】
第三十三條：要保人在本附約有效期間內，得申請減少保險金額，但是減額後的保險金額，不得低於本保
險最低承保金額，其減少部分依第十條附約終止之約定處理。
要保人申請減少保險金額後，本附約保險金的給付以減少後的保險金額為準。
【不分紅保險單】
第三十四條：本保險為不分紅保單，不參加紅利分配，並無紅利給付項目。
【投保年齡的計算及錯誤的處理】
第三十五條：要保人在申請投保時，應將被保險人出生年月日在要保書填明。
被保險人的投保年齡發生錯誤時，依下列規定辦理：
一、真實投保年齡較本公司保險費率表所載最高年齡為大者，本附約無效，其已繳保險費無
息退還要保人。
二、因投保年齡的錯誤，而致溢繳保險費者，本公司無息退還溢繳部分的保險費。但在發生
保險事故後始發覺且其錯誤發生在本公司者，本公司按原繳保險費與應繳保險費的比例
提高保險金額，而不退還溢繳部分的保險費。

三、因投保年齡的錯誤，而致短繳保險費者，要保人得補繳短繳的保險費或按照所付的保險
費與被保險人的真實年齡比例減少保險金額。但在發生保險事故後始發覺且其錯誤不可
歸責於本公司者，要保人不得要求補繳短繳的保險費。
前項第一款、第二款前段情形，其錯誤原因歸責於本公司者，應加計利息退還保險費，其利
息按退還保險費當時本公司公告的最低保險單借款利率與民法第二百零三條法定週年利率
二者取其大者計算。
【受益人的指定及變更】
第三十六條：本附約「健康險部分」保險金的受益人，為被保險人本人，本公司不受理其指定或變更。但
被保險人身故時，如有未給付予被保險人之保險金部分，則以本附約身故保險金或喪葬費用
保險金之受益人為本附約之受益人，如本附約無身故保險金或喪葬費用保險金受益人者，則
以祝壽保險金受益人為本附約之受益人，如亦無祝壽保險金受益人，則以被保險人之法定繼
承人為受益人。
除前項約定外，要保人得依下列規定指定或變更祝壽保險金、身故保險金或喪葬費用保險金
之受益人，並應符合指定或變更當時法令之規定：
一、於訂立本附約時，經被保險人同意指定受益人。
二、於保險事故發生前經被保險人同意變更受益人，如要保人未將前述變更通知本公司者，
不得對抗本公司。
前項受益人的變更，於要保人檢具申請書及被保險人的同意書（要、被保險人為同一人時為
申請書或電子申請文件）送達本公司時，本公司應即予批註或發給批註書。
受益人同時或先於被保險人本人身故，除要保人已另行指定受益人外，以被保險人之法定繼
承人為本附約受益人。
法定繼承人之順序及應得保險金之比例適用民法繼承編相關規定。
【變更住所】
第三十七條：要保人的住所有變更時，應即以書面或其他約定方式通知本公司。
要保人不為前項通知者，本公司之各項通知，得以本附約所載要保人之最後住所發送之。
【時效】
第三十八條：由本附約所生的權利，自得為請求之日起，經過兩年不行使而消滅。
【批註】
第三十九條：本附約內容的變更，或記載事項的增刪，除第三十六條規定者外，應經要保人與本公司雙方
書面或其他約定方式同意，並由本公司即予批註或發給批註書。
【管轄法院】
第四十條：因本附約涉訟者，同意以要保人住所地地方法院為第一審管轄法院，要保人的住所在中華民國
境外時，以本公司總公司所在地地方法院為第一審管轄法院。但不得排除消費者保護法第四十
七條及民事訴訟法第四百三十六條之九小額訴訟管轄法院之適用。
