【保險契約的構成】

第一條：本保險單條款、附著之要保書、批註及其他約定書，均為本保險契約（以下簡稱本契約）的

構成部分。

本契約的解釋，應探求契約當事人的真意，不得拘泥於所用的文字；如有疑義時，以作有利

於被保險人的解釋為原則。

【名詞定義】

第二條：本契約所稱「疾病」係指被保險人自本契約生效日起持續有效滿三十日後或復效日（含）起

所發生之疾病。

本契約所稱「傷害」係指被保險人於本契約有效期間內，遭受意外傷害事故，因而蒙受之傷

害。

本契約所稱「意外傷害事故」係指非由疾病引起之外來突發事故。

本契約所稱「醫院」係指依照醫療法規定領有開業執照並設有病房收治病人之公、私立及財

團法人醫院。

本契約所稱「診所」係指依照醫療法規定僅應門診且設置九張以下觀察病床者。

本契約所稱「醫師」係指領有醫師證書，合法執業者，且非要保人或被保險人本人。

本契約所稱「保險金額」係指本契約生效時保險單面頁上所載之投保金額，如該金額有所變

更時，則以變更後之保險金額為準。

本契約所稱「保單價值準備金」係指醫療部分與壽險部分合併計算，但被保險人依本契約第

十二條累計已領取之「手術醫療保險金」總額已達本契約第十六條約定之限制時，其醫療部

分則不再計入。

本契約所稱「解約金」係指醫療部分與壽險部分合併計算，但被保險人依本契約第十二條累

計已領取之「手術醫療保險金」總額已達本契約第十六條約定之限制時，其醫療部分則不再

計入。

本契約所稱「醫療部分」係指本契約第十二條之給付項目。

本契約所稱「壽險部分」係指本契約第十三條至第十五條之給付項目。

本契約所稱「年繳化保險費」，係指依「保險金額」及契約訂立時保險費率表所載之年繳化

保險費計算而得之數額。其保險費率表如附表一。

本契約所稱「已繳年繳化保險費總和」，繳費期間內係指「年繳化保險費」乘以保險事故發

生當時之保單年度數後所得之金額；繳費期滿後係指「年繳化保險費」乘以繳費期滿當時之

保單年度數後所得之金額。

【保險責任的開始及交付保險費】

第三條：本公司應自同意承保並收取第一期保險費後負保險責任，並應發給保險單作為承保的憑證。

本公司如於同意承保前，預收相當於第一期保險費之金額時，其應負之保險責任，以同意承

保時溯自預收相當於第一期保險費金

額時開始。

前項情形，在本公司為同意承保與否之意思表示前發生應予給付之保險事故時，本公司仍負

保險責任。

【契約撤銷權】

第四條：要保人於保險單送達的翌日起算十日內，得以書面檢同保險單向本公司撤銷本契約。

要保人依前項規定行使本契約撤銷權者，撤銷的效力應自要保人書面之意思表示到達翌日零

時起生效，本契約自始無效，本公司應無息退還要保人所繳保險費；本契約撤銷生效後所發

生的保險事故，本公司不負保險責任。但契約撤銷生效前，若發生保險事故者，視為未撤銷

，本公司仍應依本契約規定負保險責任。

【第二期以後保險費的交付、寬限期間及契約效力的停止】

第五條：分期繳納的第二期以後保險費，應照本契約所載交付方法及日期，向本公司所在地或指定地

點交付，或由本公司派員前往收取，並交付本公司開發之憑證。第二期以後分期保險費到期

未交付時，年繳或半年繳者，自催告到達翌日起三十日內為寬限期間；月繳或季繳者，則不

另為催告，自保險單所載交付日期之翌日起三十日為寬限期間。

約定以金融機構轉帳或其他方式交付第二期以後的分期保險費者，本公司於知悉未能依此項

約定受領保險費時，應催告要保人交付保險費，自催告到達翌日起三十日內為寬限期間。

逾寬限期間仍未交付者，本契約自寬限期間終了翌日起停止效力。如在寬限期間內發生保險

事故時，本公司仍負保險責任。

【保險費的墊繳】

第六條：要保人得於要保書或繳費寬限期間終了前以書面聲明，第二期以後的分期保險費於超過寬限

期間仍未交付者，本公司應以本契約及其附約當時的保單價值準備金（如有保險單借款者，

以扣除其借款本息後的餘額）自動墊繳本契約及其附約應繳的保險費及利息，使本契約繼續

有效。但要保人亦得於次一墊繳日前以書面通知本公司停止保險費的自動墊繳。墊繳保險費

的利息，自寬限期間終了的翌日起，按墊繳當時本公司公告的保險費自動墊繳利率計算，並

應於墊繳日後之翌日起開始償付利息；但要保人自應償付利息之日起，未付利息已逾一年以

上而經催告後仍未償付者，本公司得將其利息滾入墊繳保險費後再行計息。

前項每次墊繳保險費的本息，本公司應即出具憑證交予要保人，並於憑證上載明墊繳之本息

與本契約及其附約保單價值準備金之餘額。保單價值準備金之餘額不足墊繳一日的保險費且

經催告到達後逾三十日仍不交付時，本契約效力停止。

第一項所稱分期保險費係指本契約及其附約保險費之合計金額。

【本契約效力的恢復】

第七條：本契約停止效力後，要保人得在停效日起二年內，申請復效。

前項復效申請，經本公司同意受領要保人清償欠繳保險費扣除停效期間的危險保險費後之餘

額，自翌日上午零時起恢復效力。

第一項約定期限屆滿時，本保險效力即行終止，本契約若累積達有保單價值準備金，而要保

人未申請墊繳保險費或變更契約內容時，本公司應主動退還剩餘之保單價值準備金。

【告知義務與本

契約的解除】

第八條：要保人或被保險人在訂立本契約時，對於本公司要保書書面詢問的告知事項應據實說明，如

有故意隱匿，或因過失遺漏或為不實的說明，足以變更或減少本公司對於危險的估計者，本

公司得解除契約，其保險事故發生後亦同。但危險的發生未基於其說明或未說明的事實時，

不在此限。

前項解除契約權，自本公司知有解除之原因後，經過一個月不行使而消滅；或自契約訂立後

，經過二年不行使而消滅。

本公司通知解除本契約時，如要保人身故、居住所不明，通知不能送達時，本公司得將該項

通知送達受益人。

【契約的終止】

第九條：要保人得隨時終止本契約。

前項契約之終止，自本公司收到要保人書面通知時，開始生效。

要保人保險費已付足達一年以上或繳費累積達有保單價值準備金而終止契約時，本公司應於

接到通知後一個月內償付解約金。逾期本公司應按年利一分加計利息給付。本契約歷年解約

金額例表如保險單面頁附表。

被保險人因身故或全殘廢而致本契約效力終止時，若被保險人依本契約第十二條累計已領取

之「手術醫療保險

金」總額未達第十六條約定之限制時，本公司應於收齊身故保險金或喪葬

費用保險金（全殘廢保險金）之申領文件後一個月內將其醫療部分之解約金退還要保人。逾

期本公司應按年利一分加計利息給付。

【保險事故的通知與保險金的申請時間】

第十條：要保人或受益人應於知悉本公司應負保險責任之事故後十日內通知本公司，並於通知後儘速

檢具所需文件向本公司申請給付保險金。

本公司應於收齊前項文件後十五日內給付之。但因可歸責於本公司之事由致未在前述約定期

限內為給付者，應按年利一分加計利息給付。

【失蹤處理】

第十一條：被保險人在本契約有效期間內失蹤者，如經法院宣告死亡時，本公司根據判決內所確定死亡

時日為準，依本契約給付身故保險金或喪葬費用保險金，並依第九條第四項約定將醫療部分

之解約金退還要保人；如要保人或受益人能提出證明文件，足以認為被保險人極可能因意外

傷害事故而死亡者，本公司應依意外傷害事故發生日為準，依本契約給付身故保險金或喪葬

費用保險金，並依第九條第四項約定將醫療部分之解約金退還要保人。但日後發現被保險人

生還時，受益人及要保人應分別將該筆已領之身故保險金或喪葬費用保險金及醫療部分之解

約金歸還本公司，其間有應繳而未繳之保險費者，於要保人一次清償後，本契約自原終止日

繼續有效，本公司如有應行給付其他保險金情事者，仍依約給付。

【手術醫療保險金的給付】

第十二條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害經醫師診斷必須且實際於登記合

格之醫院或診所接受手術治療者，本公司依其投保之保險金額乘以附表二「手術項目表」中

所列該手術項目的倍數，給付「手術醫療保險金」。

同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官手術時，或同一部

位接受兩次或兩次以上手術時，僅按較高倍

數之手術項目給付「手術醫療保險金」。

被保險人所接受的手術，若不在附表二「手術項目表」所載項目且非屬條款除外責任範圍內

，但屬於事故當時行政院衛生署最新公布之「全民健康保險醫療費用支付標準」第二部第二

章第七節所載手術項目時，比照該支付點數計算給付倍數，每滿一千點為一‧五倍，支付點

數換算後少於一‧五倍者不予給付，但最高不得超過七十五倍。

【滿期保險金的給付】

第十三條：被保險人於保險年齡達七十六歲之保單週年日時生存且本契約仍屬有效者，本公司按「已繳

年繳化保險費總和」之一點一倍給付「滿期保險金」後，本契約效力即行終止。

【身故保險金或喪葬費用保險金的給付】

第十四條：被保險人於本契約有效期間內身故者，本公司按「已繳年繳化保險費總和」之一點一倍給付

「身故保險金」。但被保險人發生上述保險事故時之保單價值準備金大於「已繳年繳化保險

費總和」之一點一倍時，本公司則以保單價值準備金給付之。

本公司依前項約定給付「身故保險金」後，本契約效力即行終止。但訂立本契約時，以未滿

十四足歲之未成年人，或心神喪失或精神耗弱之人為被保險人，其身故保險金變更為喪葬費

用保險金。

以未滿十四足歲之未成

年人，或心神喪失或精神耗弱之人為被保險人，於民國九十年七月十

一日（含）以後所投保之喪葬費用保險金額總和（不限本公司），不得超過主管機關所訂定

之喪葬費用額度上限，其超過部分本公司不負給付責任，本公司並應無息退還該超過部分之

已繳保險費。

前項情形，如要保人向二家（含）以上公司投保，且其投保之喪葬費用保險金額合計超過前

項所定之限額者，本公司於所承保之喪葬費用金額範圍內，依各要保書所載之要保時間先後

，依約給付喪葬費用保險金至主管機關所訂定之喪葬費用額度上限為止，如有二家以上公司

之保險契約要保時間相同或無法區分其要保時間之先後者，各該公司應依其喪葬費用保險金

額與扣除要保時間在先之公司應理賠之金額後所餘之限額比例分擔其責任。

前二項所稱主管機關所訂定之喪葬費用額度上限如下：

一、民國九十一年十二月三十一日（含）以前為新台幣一百萬元。

二、民國九十二年一月一日起調整為新台幣二百萬元。

三、民國九十二年十月一日起要保之簡易人壽保險契約其喪葬費用保險金額應合併計算。

【全殘廢保險金的給付】

第十五條：被保險人於本契約有效期間內致成附表三「全殘廢項目表」中所列全殘廢項目之一時，本公

司按「已繳年繳化保險費總和」之一點一倍給付「全殘廢保險金」。但被保險人發生上述保

險事故時之保單價值準備金大於「已繳年繳化保險費總和」之一點一倍時，本公司則以保單

價值準備金給付之。

本公司依前項約定給付「全殘廢保險金」後，本契約的效力即行終止。

【保險金給付的限制】

第十六條：本公司依本契約第十二條給付之「手術醫療保險金」，其累計最高以「保險金額」的一千五

百倍為限。

被保險人依本契約第十二條累計已領取之「手術醫療保險金」總額達「保險金額」的一千五

百倍時，其醫療部分之效力即行終止。

【手術醫療保險金的申領】

第十七條：受益人申領「手術醫療保險金」時，應檢具下列文件：

一、保險金申請書。

二、醫療診斷書。（但要保人或被保險人為醫師時，不得為被保險人出具診斷書。）

三、手術證明文件。

受益人申領手術醫療保險金時，本公司於必要時得經其同意調閱被保險人之就醫相關資料，

其費用由本公司負擔。

【滿期保險金的申領】

第十八條：受益人申領「滿期保險金」時，應檢具下列文件：

一、保險單或其謄本。

二、保險金申請書。

三、受益人的身分證明。

【身故保險金或喪葬費用保險金的申領】

第十九條：受益人申領「身故保險金」或喪葬費用保險金時應檢具下列文件：

一、保險單或其謄本。

二、被保險人死亡證明書或相驗屍體證明書，及除戶戶籍謄本。

三、保險金申請書。

四、受益人的身分證明。

【全殘廢保險金的申領】

第二十條：受益人申領「全殘廢保險金」時，應檢具下列文件：

一、保險單或其謄本。

二、殘廢診斷書。

三、保險金申請書。

四、受益人的身分證明。

受益人申領全殘廢保險金時，本公司得對被保險人的身體予以檢驗，必要時並得經受益人同

意調閱被保險人之就醫相關資料，其費用由本公司負擔。

【手術醫療保險金之除外責任】

第二十一條：被保險人因下列原因所致之疾病或傷害而接受手術治療者，本公司不負給付「手術醫療保

險金」的責任。

一、被保險人之故意行為（包括自殺及自殺未遂）。

二、被保險人之犯罪行為。

三、被保險人非法施用防制毒品相關法令所稱之毒品。被保險人因下列事故而接受手術治

療者，本公司不負給付「手術醫療保險金」的責任。

一、美容手術、外科整型。但為重建其基本功能所作之必要整型，不

在此限。

二、外觀可見之天生畸形。

三、健康檢查、療養、靜養、戒毒、戒酒、護理或養老之非以直接診治病人為目的者。

四、懷孕、流產或分娩及其併發症。但下列情形不在此限：

（一）懷孕相關疾病：

1.子宮外孕。

2.葡萄胎。

3.前置胎盤。

4.胎盤早期剝離。

5.產後大出血。

6.子癲前症。

7.子癇症。

8.萎縮性胚胎。

9.胎兒染色體異常之手術。

（二）因醫療行為所必要之流產，包含：

1.因本人或其配偶患有礙優生之遺傳性、傳染性疾病或精神疾病。

2.因本人或其配偶之四親等以內之血親患有礙優生之遺傳性疾病。

3.有醫學上理由，足以認定懷孕或分娩有招致生命危險或危害身體或精神健康。

4.有醫學上理由，足以認定胎兒有畸型發育之虞。

5.因被強制性交、誘姦或與依法不得結婚者相姦而受孕者。

（三）醫療行為必要之剖腹產，並符合下列情況者：

1.產程遲滯：已進行充足引產，但第一產程之潛伏期過長（經產婦超過14小時、初

產婦超過20小時），或第一產程之活動期子宮口超過2小時仍無進一步擴張，或第

二產程超過2小時胎頭仍無下降。

2.胎兒窘迫，係指下列情形之一者：

a.在子宮無收縮情況下，胎心音圖顯示每分鐘大於160次或少於100次且呈持續性

者，或胎兒心跳低於基礎心跳每分鐘30次且持續60秒以上者。

b.胎兒頭皮酸鹼度檢查PH值少於7.20者。

3.胎頭骨盆不對稱，係指下列情形之一者：

a.胎頭過大（胎兒頭圍37公分以上）。

b.胎兒超音波檢查顯示巨嬰（胎兒體重4000公克以上）。

c.骨盆變形、狹窄（骨盆內口10公分以下或中骨盆9.5公分以下）並經骨盆腔攝影

確定者。

d.骨盆腔腫瘤（包括子宮下段之腫瘤，子宮頸之腫瘤及會引起產道壓迫阻塞之骨

盆腔腫瘤）致影響生產者。

4.胎位不正。

5.多胞胎。

6.子宮頸未全開而有臍帶脫落時。

7.兩次（含）以上的死產（懷孕24周以上，胎兒體重560公克以上）。

8.分娩相關疾病：

a.前置胎盤。

b.子癲前症及子癇症。

c.胎盤早期剝離。

d.早期破水超過24小時合併感染現象。

e.母體心肺疾病：

（a）嚴重心律不整，並附心臟科專科醫師診斷證明或心電圖檢查認定須剖腹產

者。

（b）經心臟科採用之心肺功能分級認定為第三或第四級心臟病，並附診斷證明

。

（c）嚴重肺氣腫，並附胸腔科專科醫師診斷證明。

五、不孕症、人工受孕或非以治療為目的之避孕及絕育手術。

【身故保險金或喪葬費用保險金及全殘廢保險金之除外責任】

第二十二條：有下列情形之一者，本公司不負給付第十四條及第十五條保險金的責任。

一、要保人故意致被保險人於死。

二、被保險人故意自殺或自成全殘廢。但自本契約訂立或復效之日起二年後故意自殺致死

者，本公司仍負給付身故保險金或喪葬費用保險金之責任。

三、被保險人因犯罪處死或拒捕或越獄致死或全殘廢。

前項第一款及第二十三條情形致被保險人全殘廢時，本公司按第十五條的約定給付全殘廢

保險金。

因第一項各款情形而免給付保險金者，本契約累積達有保單價值準備金時，依照約定給付

保單價值準備金予應得之人。

【受益人之受益權】

第二十三條：受益人故意致被保險人於死或雖未致死者，喪失其受益權。

前項情形，如因該受益人喪失受益權，而致無受益人受領保險金額時，其保險金額作為被

保險人遺產。如有其他受益人者，喪失受益權之受益人原應得之部份，按其他受益人原約

定比例分歸其他受益人。

【欠繳保險費或未還款項的扣除】

第二十四條：本公司給付各項保險金、解約金或返還保單價值準備金時，如要保人有欠繳保險費（包括

經本公司墊繳的保險費）或保險單借款未還清者，本公司得先抵銷上述欠款及扣除其應付

利息後給付其餘額。

【減少保險金額】

第二十五條：要保人在本契約有效期間內，得申請減少保險金額，但是減額後的保險金額不得低於本保

險最低承保金額，其減少部分依第九條契約終止之約定處理

。

【減額繳清保險】

第二十六條：要保人於繳費期間內繳足保險費累積達有保單價值準備金時，要保人得以當時保單價值準

備金扣除營業費用後的數額作為一次繳清的躉繳保險費，向本公司申請改保同類保險的「

減額繳清保險」，其保險金額如保險單面頁附表。要保人變更為「減額繳清保險」後，不

必再繼續繳保險費，本契約繼續有效。其條件與原契約同，但保險金額以減額繳清保險金

額為準。其「年繳化保險費」則依減額繳清保險金額所對應保險費計算之。

要保人依前項約定辦理「減額繳清保險」當時，若被保險人依本契約第十二條累計已領取

之「手術醫療保險金」總額已達本契約第十六條約定之限制者，其醫療部分不再適用，僅

變更為壽險部分「減額繳清保險」。

要保人選擇改為「減額繳清保險」當時，倘有保險單借款或欠繳、墊繳保險費的情形，本

公司將以保單價值準備金扣除欠繳保險費或借款本息或墊繳保險費本息及營業費用後的淨

額辦理。

第一項及第三項營業費用以申請當時原「已繳年繳化保險費總和」一點一倍之百分之一或

以其保單價值準備金與其解約金之差額，兩者較小者為限。

【展期定期保險】

第二十七條：要保人於繳費期間內繳足保險費累積達有保單價值準備金時，要保人得以當時保單價值準

備金扣除營業費用後的數額作為一次繳清的躉繳保險費，向本公司申請改為「展期定期保

險」，其保險金額為申請當時「已繳年繳化保險費總和」之一點一倍扣除保險單借款本息

或墊繳保險費本息後之餘額。要保人不必再繼續繳保險費，其展延期間如保險單面頁附表

，但不得超過原契約的滿期日。

要保人依前項約定辦理展期定期保險後，即喪失本契約第十二條「手術醫療保險金」給付

之權利，但被保險人於展延期間內身故或全殘廢時，本公司按前項約定金額給付保險金後

，本契約即行終止，且不適用第九條第四項之約定。

如當時保單價值準備金扣除營業費用後的數額超過展期定期保險至滿期日所需的躉繳保險

費時，要保人得以其超過款額作為一次躉繳保險費，購買於本契約繳費期滿時給付的「繳

清生存保險」，其保險金額如保險單面頁附表。

要保人選擇改為「展期定期保險」當時，倘有保險單借款或欠繳、墊繳保險費的情形，本

公司將以保單價值準備金扣除欠繳保險費或借款本息或墊繳保險費本息及營業費用後的淨

額辦理。

第一項及前二項營業費用以原「已繳年繳化保險費總和」一點一倍之百分之一或以其保單

價值準備金與其解約金之差額，兩者較小者為限。

【保險單借款】

第二十八條：要保人繳足保險費累積達有保單價值準備金時，要保人得在保單價值準備金範圍內向本公

司申請保險單借款，未償還之借款本息，超過其保單價值準備金時，本契約效力即行停止

。但本公司應於效力停止日之三十日前以書面通知要保人。

【保險單紅利的計算及給付】

第二十九條：本保險為不分紅保單，不參

加紅利分配，並無紅利給付項目。

【投保年齡的計算及錯誤的處理】

第三十條：要保人在申請投保時，應將被保險人出生年月日在要保書填明。被保險人的投保年齡，以

足歲計算，但未滿一歲的零數超過六個月者，加算一歲。

被保險人的投保年齡發生錯誤時，依下列規定辦理：

一、因投保年齡的錯誤，而致溢繳保險費者，本公司無息退還溢繳部份的保險費。但在發

生保險事故後始發覺且其錯誤發生在本公司者，本公司按原繳保險費與應繳保險費的

比例提高保險金額，而不退還溢繳部分的保險費。

二、因投保年齡的錯誤，而致短繳保險費者，應補足其差額。但在發生保險事故後始發覺

且其錯誤並非發生在本公司者，本公司得按原繳保險費與應繳保險費的比例減少保險

金額，而不得請求補足差額。

前項第一款前段情形，其錯誤原因歸責於本公司者，應加計利息退還保險費，其利息按退

還保險費當時本保單辦理保單借款之利率計算。

【受益人的指定及變更】

第三十一條：全殘廢保險金及手術醫療保險金的受益人，為被保險人本人，本公司不受理其指定或變更

。但被保險人身故時，如有未給付予被保險人之保險金部分，則以本契約身故保險金或喪

葬費用保險金之受益人為本契約之受益人，如本契約無身故保險金或喪葬費用保險金受益

人者，則以滿期保險金受益人為本契約之受益人，如亦無滿期保險金受益人，則以被保險

人之法定繼承人為受益人。

除前項約定外，要保人得依下列規定指定或變更受益人：

一、於訂立本契約時，經被保險人同意指定受益人。

二、於保險事故發生前經被保險人同意變更受益人，如要保人未將前述變更通知本公司者

，不得對抗本公司。

前項受益人的變更，於要保人檢具申請書及被保險人的同意書送達本公司時，本公司應即

予批註或發給批註書。

受益人同時或先於被保險人本人身故，除要保人已另行指定受益人外，以被保險人之法定

繼承人為本契約受益人。

法定繼承人之順序及應得保險金

之比例適用民法繼承編相關規定。

【變更住所】

第三十二條：要保人的住所有變更時，應即以書面通知本公司。

要保人不為前項通知者，本公司之各項通知，得以本契約所載要保人之最後住所發送之。

【時效】

第三十三條：由本契約所生的權利，自得為請求之日起，經過兩年不行使而消滅。

【批註】

第三十四條：本契約內容的變更，或記載事項的增刪，除第三十一條規定者外，應經要保人與本公司雙

方書面同意，並由本公司即予批註或發給批註書。

【管轄法院】

第三十五條：因本契約涉訟者，同意以要保人住所地地方法院為第一審管轄法院，要保人的住所在中華

民國境外時，以本公司總公司所在地地方法院為第一審管轄法院。但不得排除消費者保護

法第四十七條及民事訴訟法第四百三十六條之九小額訴訟管轄法院之適用。

附表三全殘廢項目表

一、雙目均失明者。（註 1）

二、兩上肢腕關節缺失者或兩下肢足踝關節缺失者。

三、一上肢腕關節及一下肢足踝關節缺失者。

四、一目失明及一上肢腕關節缺失者或一目失明及一下肢足踝關節缺失者。

五、永久喪失咀嚼（註 2）或言語（註 3）之機能者。

六、四肢機能永久完全喪失者。（註 4）

七、中樞神經系統機能遺存極度障害或胸、腹部臟器機能遺存極度障害，終身不能從事任何工作，

經常需醫療護理或專人周密照護者。（註 5）

註：

1.失明的認定

（1）視力的測定，依據萬國式視力表，兩眼個別依矯正視力測定之。

（2）失明係指視力永久在萬國式視力表零點零二以下而言。

（3）以自傷害之日起經過六個月的治療為判定原則，但眼球摘出等明顯無法復原之情況，不在此限。

2.喪失咀嚼之機能係指因器質障害或機能障害，以致不能作咀嚼運動，除流質食物外，不能攝取者。

3.喪失言語之機能係指後列構成語言之口唇音、齒舌音、口蓋音、喉頭音等之四種語音機能中，有三種

以上不能構音者。

4.所謂機能永久完全喪失係指經六個月以後其機能仍完全喪失者。

5.因重度神經障害，為維持生命必要之日常生活活動，全須他人扶助者。

上述「為維持生命必要之日常生活活動」係指食物攝取、大小便始末、穿脫衣服、起居、步行、入浴

等。
