    手術醫療保險金、住院手術療養保險金、門診手術療養保險金、治療處置保險金、放射線診療保險金、
    重大手術慰問保險金、無理賠增額保險金、所繳保險費的退還、身故保險金或喪葬費用保險金、祝壽保
    險金、一至六級失能生活扶助保險金）
    本商品之疾病等待期間為生效日起持續有效滿三十天以內。
    本保險因費率計算考慮脫退率致本險無解約金。

    【保險契約的構成】
    第 一 條：本保險單條款、附著之要保書、批註及其他約定書，均為本保險契約（以下簡稱本契約）的
    構成部分。
    本契約的解釋，應探求契約當事人的真意，不得拘泥於所用的文字；如有疑義時，以作有利
    於被保險人的解釋為原則。
    【名詞定義】
    第 二 條：本契約所稱名詞定義如下：
    一、本契約所稱「疾病」，係指被保險人自本契約生效日起持續有效滿三十日後或復效日（含）
    起所發生之疾病。但如被保險人投保時之保險年齡為零歲者，其遺傳性疾病之新生兒先
    天性代謝異常疾病檢查項目(以中央衛生主管機關公告為準)，不適用前述自本契約生效
    日起需持續有效滿三十日之限制。
    二、本契約所稱「傷害」，係指被保險人於本契約有效期間內，遭受意外傷害事故，因而蒙受
    之傷害。
    三、本契約所稱「意外傷害事故」，係指非由疾病引起之外來突發事故。
    四、本契約所稱「醫院」，係指依照醫療法規定領有開業執照並設有病房收治病人之公、私立
    及醫療法人醫院。
    五、本契約所稱「住院」，係指被保險人經醫師診斷其疾病或傷害必須入住醫院，且正式辦理
    住院手續並確實在醫院接受診療者。但不包含全民健康保險法第五十一條所稱之日間住
    院及精神衛生法第三十五條所稱之日間留院。
    六、本契約所稱「醫師」，係指領有醫師證書而合法執業者，且非要保人或被保險人本人。
    七、本契約所稱「同一次住院」，係指被保險人於本契約有效期間，因同一疾病或傷害，或因
    此引起之併發症，於出院後十四日內於同一醫院再次住院時，其各項保險金給付及其限
    制，視為同一次住院辦理，倘被保險人係於本契約有效期間屆滿後出院者，本公司就再
    次住院部分不予給付保險金。
    八、本契約所稱「住院日數」，係指被保險人經正式辦理住院手續並確實在醫院接受診療之日
    數（含入院及出院當日）。
    九、本契約所稱「診所」，係指依照醫療法規定領有開業執照之診所。
    十、本契約所稱「住院醫療日額」，係指本契約生效時保險單面頁上所載之投保金額，如該金
    額有所變更時，則以變更後之保險金額為準。
    十一、本契約所稱「保險年齡」，係指按投保時被保險人以足歲計算之年齡，但未滿一歲的零
    數超過六個月者加算一歲，以後每經過一個保單年度加算一歲。
    十二、本契約所稱「表定保費」，係指依該繳費方法所對應附表一所載之保險費率乘以「住院
    醫療日額」計算而得之金額。
    十三、本契約所稱「保險費總和」， 係指依保險事故發生時之繳費方法所對應之「表定保費」，
    乘以該繳費方法自契約訂立後之累計應繳保險費次數後之金額。

    十四、本契約所稱「所繳保險費」， 係以保險費率表所載金額為基礎。
    十五、本契約所稱「已領醫療保險金倍數」，係指申領第六條至第十七條各項保險金時，其合
    計金額除以申領當時「住院醫療日額」之數值。
    十六、本契約所稱「累計已領醫療保險金倍數」，係指自契約生效日起累計之「已領醫療保險
    金倍數」之數值。
    十七、本契約所稱「醫療部分」，係指本契約第六條至第十七條之給付項目。
    【契約撤銷權】
    第 三 條：要保人於保險單送達的翌日起算十日內，得以書面或其他約定方式檢同保險單向本公司撤銷
    本契約。
    要保人依前項規定行使本契約撤銷權者，撤銷的效力應自要保人書面或其他約定方式之意思
    表示到達翌日零時起生效，本契約自始無效，本公司應無息退還要保人所繳保險費；本契約
    撤銷生效後所發生的保險事故，本公司不負保險責任。但契約撤銷生效前，若發生保險事故
    者，視為未撤銷，本公司仍應依本契約規定負保險責任。
    【保險責任的開始及交付保險費】
    第 四 條：本公司應自同意承保並收取第一期保險費後負保險責任，並應發給保險單作為承保的憑證。
    本公司如於同意承保前，預收相當於第一期保險費之金額時，其應負之保險責任，以同意承
    保時溯自預收相當於第一期保險費金額時開始。
    前項情形，在本公司為同意承保與否之意思表示前發生應予給付之保險事故時，本公司仍負
    保險責任。
    【保險範圍】
    第 五 條：被保險人於本契約有效期間內身故、因第二條約定之疾病或傷害住院診療、接受手術治療、
    接受治療處置、接受放射線診療、保險年齡未超過六十五歲失能或於保險年齡達一○一歲之
    保單週年日時仍生存者，本公司依本契約約定給付保險金。
    【住院醫療保險金的給付】
    第 六 條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，本公司按被保險人
    於同一次住院期間之實際住院日數及「住院醫療日額」，依下表給付「住院醫療保險金」：
    同一次住院期間之實際住院日數

    被保險人同一保單年度同一次住院之實際住院給付日數，最高以三百六十五日為限。
    【住院療養保險金的給付】
    第 七 條：被保險人符合第六條之約定，另按「住院醫療日額」的百分之五十乘以該被保險人於同一次
    住院期間之實際住院日數，給付「住院療養保險金」。
    被保險人同一保單年度同一次住院之實際住院給付日數，最高以三百六十五日為限。

    【加護病房保險金的給付】
    第 八 條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害而進住加護病房診療時，本公司
    除依第六條約定給付「住院醫療保險金」外，另按「住院醫療日額」的二倍乘以該被保險人
    實際進住加護病房之日數(含轉進及轉出當日)，給付「加護病房保險金」。
    被保險人同一保單年度同一次住院之實際進住加護病房給付日數，最高以三百六十五日為限。
    【燒燙傷病房保險金的給付】
    第 九 條：被保險人於本契約有效期間內，因第二條約定之傷害而進住燒燙傷病房診療時，本公司除依
    第六條約定給付「住院醫療保險金」外，另按「住院醫療日額」的二倍乘以該被保險人實際
    進住燒燙傷病房之日數(含轉進及轉出當日)，給付「燒燙傷病房保險金」。
    被保險人同一保單年度同一次住院之實際進住燒燙傷病房給付日數，最高以三百六十五日為
    限。
    【住院前後門診醫療保險金的給付】
    第 十 條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，於其住院診療的前
    十四日內及出院後十四日內，因與住院同一疾病或傷害而接受門診診療者，本公司按「住院
    醫療日額」的百分之五十乘以實際門診次數，給付「住院前後門診醫療保險金」。但每日門
    診以給付一次為限。
    【手術醫療保險金的給付】
    第十一條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院
    或診所接受手術治療者，本公司按「住院醫療日額」乘以附表二「手術項目表」中所列該手
    術項目的倍數，給付「手術醫療保險金」。
    被保險人於門診當天或同一次住院期間接受兩項以上手術時，其各項手術醫療保險金應分別
    計算。但同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官手術時；
    或同一部位接受兩次或兩次以上手術時，僅按較高倍數之手術項目給付「手術醫療保險金」。
    被保險人所接受的手術，若不在附表二「手術項目表」所載項目且非屬第二十二條除外責任
    範圍內，但屬於事故當時中央衛生主管機關最新公布之「全民健康保險醫療費用支付標準」
    第二部第二章第七節所載手術項目時，本公司將比照附表二「手術項目表」內程度相當之手
    術項目決定給付倍數，但最高不得超過一百倍。
    【住院手術療養保險金的給付】
    第十二條：被保險人符合第十一條之約定且實際於住院期間接受手術治療者，另按「住院醫療日額」的
    五倍，給付「住院手術療養保險金」。
    被保險人於同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官手術
    時；或同一次住院期間，同一部位接受兩次或兩次以上手術時，僅給付一次「住院手術療養
    保險金」。

    【門診手術療養保險金的給付】
    第十三條：被保險人符合第十一條之約定且實際接受門診手術治療者，另按「住院醫療日額」的一倍，
    給付「門診手術療養保險金」。
    被保險人於同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官手術
    時；或門診當天，同一部位接受兩次或兩次以上手術時，僅給付一次「門診手術療養保險金」。
    【治療處置保險金的給付】
    第十四條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院
    或診所接受治療處置者，本公司按「住院醫療日額」乘以附表三「治療處置項目表」中所列
    該治療處置項目的倍數，給付「治療處置保險金」。若不在附表三上之項目，本公司不負給
    付責任。
    被保險人於門診當天或同一次住院期間接受兩項以上治療處置時，其各項治療處置保險金應
    分別計算。但同一次治療處置中，於同一位置接受兩項以上之治療處置項目或兩項以上器官
    治療處置時；或同一部位接受兩次或兩次以上治療處置時，僅按較高倍數之治療處置項目給
    付「治療處置保險金」。
    【放射線診療保險金的給付】
    第十五條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院
    或診所接受放射線診療者，本公司按「住院醫療日額」乘以附表四「放射線診療項目表」中
    所列該放射線診療項目的倍數，給付「放射線診療保險金」。若不在附表四上之項目，本公
    司不負給付責任。
    被保險人於門診當天或同一次住院期間接受兩項以上放射線診療時，其各項放射線診療保險
    金應分別計算。但同一次放射線診療中，於同一位置接受兩項以上之放射線診療項目或兩項
    以上器官放射線診療時；或同一部位接受兩次或兩次以上放射線診療時，僅按較高倍數之放
    射線診療項目給付「放射線診療保險金」。
    【重大手術慰問保險金的給付】
    第十六條：被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療，並接受附表五「重大
    手術項目表」中所列重大手術項目之一時，本公司除依約定給付「住院醫療保險金」、「住
    院療養保險金」、「手術醫療保險金」及「住院手術療養保險金」外，另按「住院醫療日額」
    乘以附表五「重大手術項目表」中所列該重大手術項目的倍數，給付「重大手術慰問保險金」。
    被保險人於門診當天或同一次住院期間接受兩項以上重大手術時，其各項重大手術慰問保險
    金應分別計算。但同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官
    手術時；或同一部位接受兩次或兩次以上手術時，僅給付一次「重大手術慰問保險金」。
    【無理賠增額保險金的給付】
    第十七條：受益人於申領第六條至第十六條之各項保險金時，如於本次保險事故發生時前二個保單年度
    (含)以上，未依第六條至第十六條之約定申請各項保險金且本契約持續有效時，本公司除依
    第六條至第十六條約定給付各項保險金外，另依未申請各項保險金之保單年度數按第六條至
    第十六條各項保險金給付合計金額乘以下表連續未申請各項保險金保單年度數所對應之增額

    【保險金給付的限制】
    第十八條：本公司依本契約第六條至第十六條給付之各項保險金，其累計最高以「住院醫療日額」的三
    千五百倍為限。
    【所繳保險費的退還、身故保險金或喪葬費用保險金的給付】
    第十九條：被保險人於本契約有效期間內且年滿十五足歲起，於未達保險年齡十六歲之保單週年日前身
    故時，本公司按身故時之所繳保險費給付身故保險金；於達保險年齡十六歲之保單週年日起
    身故時，本公司則以身故時「保險費總和」的一點零六倍扣除「住院醫療日額」乘以「累計
    已領醫療保險金倍數」後之金額給付身故保險金。
    本公司依約定給付身故保險金後，本契約效力即行終止。
    訂立本契約時，以未滿十五足歲之未成年人為被保險人，其身故保險金之給付於被保險人滿
    十五足歲之日起發生效力；被保險人滿十五足歲前身故者，本公司應退還所繳保險費予要保
    人或應得之人。本公司退還所繳保險費後，本契約效力即行終止。
    訂立本契約時，以受監護宣告尚未撤銷者為被保險人，第一項身故保險金均變更為喪葬費用
    保險金。
    前項被保險人於民國九十九年二月三日（含）以後所投保之喪葬費用保險金額總和（不限本
    公司），不得超過訂立本契約時遺產及贈與稅法第十七條有關遺產稅喪葬費扣除額之半數，其
    超過部分本公司不負給付責任，本公司並應無息退還該超過部分之已繳保險費。
    前項情形，如要保人向二家（含）以上保險公司投保，或向同一保險公司投保數個保險契（附）
    約，且其投保之喪葬費用保險金額合計超過前項所定之限額者，本公司於所承保之喪葬費用
    金額範圍內，依各要保書所載之要保時間先後，依約給付喪葬費用保險金至前項喪葬費用額
    度上限為止，如有二家以上保險公司之保險契約要保時間相同或無法區分其要保時間之先後
    者，各該保險公司應依其喪葬費用保險金額與扣除要保時間在先之保險公司應理賠之金額後
    所餘之限額比例分擔其責任。
    【祝壽保險金的給付】
    第 二十 條：被保險人於保險年齡達一○一歲之保單週年日時仍生存且本契約仍屬有效者，本公司按「
    保險費總和」的一點零六倍扣除「住院醫療日額」乘以「累計已領醫療保險金倍數」後之
    金額給付「祝壽保險金」。本公司依約定給付「祝壽保險金」後，本契約效力即行終止。
    【一至六級失能生活扶助保險金的給付】
    第二十一條：被保險人於本契約有效期間內，符合下列約定之一且經醫院診斷確定者，本公司於認定之

    日(含)，及每屆滿一年仍生存時，按「住院醫療日額」的六十倍給付「一至六級失能生活
    扶助保險金」，且以給付二十次為限：
    一、保險年齡未超過六十五歲時，因第二條約定之疾病致成附表六所列第一至六級失能程
    度之一者。
    二、保險年齡未超過六十五歲時，遭受第二條約定的意外傷害事故，自意外傷害事故發生
    之日起一百八十日以內致成附表六所列第一至六級失能項目之一者。但超過一百八十
    日致成失能者，受益人若能證明被保險人之失能與該意外傷害事故具有因果關係者，
    不在此限。
    被保險人因同一疾病或傷害致成附表六所列第一至六級失能程度二項以上時，本公司僅給
    付一項「一至六級失能生活扶助保險金」。
    被保險人因本次疾病或傷害所致之失能，如合併本契約訂立後的失能，符合附表六所列第
    一至六級失能程度之一者，本公司給付「一至六級失能生活扶助保險金」，但合併之失能
    中若涵蓋本公司已給付之失能項目者，則該項目不適用合併之約定，本公司僅就未給付項
    目部分合併計算；本契約訂立前所致成的失能，屬已發生之危險，本公司不負給付責任。
    「一至六級失能生活扶助保險金」於本契約有效期間內，每一保單年度以給付一次為限。
    【「醫療部分」、一至六級失能生活扶助保險金之除外責任】
    第二十二條：被保險人因下列原因所致之疾病或傷害而住院診療、接受手術治療、接受治療處置、接受
    放射線診療或失能者，本公司不負給付第六條至第十七條、第二十一條各項保險金的責任
    。
    一、被保險人之故意行為（包括自殺及自殺未遂）。
    二、被保險人之犯罪行為。
    三、被保險人非法施用防制毒品相關法令所稱之毒品。
    被保險人因下列事故而住院診療、接受手術治療、接受治療處置、接受放射線診療或失能
    者，本公司不負給付第六條至第十七條、第二十一條各項保險金的責任。
    一、美容手術、外科整型。但為重建其基本功能所作之必要整型，不在此限。
    二、外觀可見之天生畸形。
    三、健康檢查、療養、靜養、戒毒、戒酒、護理或養老之非以直接診治病人為目的者。
    四、懷孕、流產或分娩及其併發症。但下列情形不在此限：
    （一）懷孕相關疾病：
    1.子宮外孕。
    2.葡萄胎。
    3.前置胎盤。
    4.胎盤早期剝離。
    5.產後大出血。
    6.子癲前症。
    7.子癇症。
    8.萎縮性胚胎。
    9.胎兒染色體異常之手術。
    （二）因醫療行為所必要之流產，包含：

    1.因本人或其配偶患有礙優生之遺傳性、傳染性疾病或精神疾病。
    2.因本人或其配偶之四親等以內之血親患有礙優生之遺傳性疾病。
    3.有醫學上理由，足以認定懷孕或分娩有招致生命危險或危害身體或精神健康。
    4.有醫學上理由，足以認定胎兒有畸型發育之虞。
    5.因被強制性交、誘姦或與依法不得結婚者相姦而受孕者。
    （三）醫療行為必要之剖腹產，並符合下列情況者：
    1.產程遲滯：已進行充足引產，但第一產程之潛伏期過長（經產婦超過 14 小時、
    初產婦超過 20 小時），或第一產程之活動期子宮口超過 2 小時仍無進一步擴張，
    或第二產程超過 2 小時胎頭仍無下降。
    2.胎兒窘迫，係指下列情形之一者：
    a.在子宮無收縮情況下，胎心音圖顯示每分鐘大於 160 次或少於 100 次且呈持
    續性者，或胎兒心跳低於基礎心跳每分鐘 30 次且持續 60 秒以上者。
    b.胎兒頭皮酸鹼度檢查 PH 值少於 7.20 者。
    3.胎頭骨盆不對稱，係指下列情形之一者：
    a.胎頭過大（胎兒頭圍 37 公分以上）。
    b.胎兒超音波檢查顯示巨嬰（胎兒體重 4000 公克以上）。
    c.骨盆變形、狹窄（骨盆內口 10 公分以下或中骨盆 9.5 公分以下）並經骨盆腔
    攝影確定者。
    d.骨盆腔腫瘤（包括子宮下段之腫瘤，子宮頸之腫瘤及會引起產道壓迫阻塞之
    骨盆腔腫瘤）致影響生產者。
    4.胎位不正。
    5.多胞胎。
    6.子宮頸未全開而有臍帶脫落時。
    7.兩次（含）以上的死產（懷孕 24 周以上，胎兒體重 560 公克以上）。
    8.分娩相關疾病：
    a.前置胎盤。
    b.子癲前症及子癇症。
    c.胎盤早期剝離。
    d.早期破水超過 24 小時合併感染現象。
    e.母體心肺疾病：
    （a）嚴重心律不整，並附心臟科專科醫師診斷證明或心電圖檢查認定須剖腹
    產者。
    （b）經心臟科採用之心肺功能分級認定為第三或第四級心臟病，並附診斷證
    明。
    （c）嚴重肺氣腫，並附胸腔科專科醫師診斷證明。
    五、不孕症、人工受孕或非以治療為目的之避孕及絕育手術。
    【身故保險金或喪葬費用保險金之除外責任】
    第二十三條：有下列情形之一者，本公司不負給付第十九條身故保險金或喪葬費用保險金的責任。
    一、要保人故意致被保險人於死。

    二、被保險人故意自殺。但自本契約訂立或復效之日起二年後故意自殺致死者，本公司仍
    負給付身故保險金或喪葬費用保險金之責任。
    三、被保險人因犯罪處死或拒捕或越獄致死。
    被保險人滿十五足歲前因第一項各款原因致死者，本公司依第十九條約定退還所繳保險費
    予要保人或應得之人。
    【第二期以後保險費的交付、寬限期間及契約效力的停止】
    第二十四條：分期繳納的第二期以後保險費，應照本契約所載交付方法及日期，向本公司所在地或指定
    地點交付，或由本公司派員前往收取，並交付本公司開發之憑證。第二期以後分期保險費
    到期未交付時，年繳或半年繳者，自催告到達翌日起三十日內為寬限期間；月繳或季繳者
    ，則不另為催告，自保險單所載交付日期之翌日起三十日為寬限期間。
    約定以金融機構轉帳或其他方式交付第二期以後的分期保險費者，本公司於知悉未能依此
    項約定受領保險費時，應催告要保人交付保險費，自催告到達翌日起三十日內為寬限期間
    。
    逾寬限期間仍未交付者，本契約自寬限期間終了翌日起停止效力。如在寬限期間內發生保
    險事故時，本公司仍負保險責任。
    本公司依約定催告要保人交付保險費時，其通知應送達於要保人，或負有交付保險費義務
    之人之最後住所或居所，保險費經催告後，應於本公司營業所交付之。
    【本契約效力的恢復】
    第二十五條：本契約停止效力後，要保人得在停效日起二年內，申請復效。但保險期間屆滿後不得申請
    復效。
    要保人於停止效力之日起六個月內提出前項復效申請，並經要保人清償保險費扣除停效期
    間的危險保險費後之餘額及按保險費之預定利率計算之利息後，自翌日上午零時起，開始
    恢復其效力。
    要保人於停止效力之日起六個月後提出第一項之復效申請者，本公司得於要保人之復效申
    請送達本公司之日起五日內要求要保人提供被保險人之可保證明。要保人如未於十日內交
    齊本公司要求提供之可保證明者，本公司得退回該次復效之申請。
    被保險人之危險程度有重大變更已達拒絕承保程度者，本公司得拒絕其復效。
    本公司未於第三項約定期限內要求要保人提供可保證明，或於收齊可保證明後十五日內不
    為拒絕者，視為同意復效，並經要保人清償第二項所約定之金額後，自翌日上午零時起，
    開始恢復其效力。
    要保人依第三項提出申請復效者，除有同項後段或第四項之情形外，於交齊可保證明，並
    清償第二項所約定之金額後，自翌日上午零時起，開始恢復其效力。
    第一項約定期限屆滿時，本契約效力即行終止。
    【告知義務與本契約的解除】
    第二十六條：要保人或被保險人在訂立本契約時，對於本公司要保書書面詢問的告知事項應據實說明，
    如有為隱匿或遺漏不為說明，或為不實的說明，足以變更或減少本公司對於危險的估計者
    ，本公司得解除本契約，其保險事故發生後亦同。但危險的發生未基於其說明或未說明的

    事實時，不在此限。
    前項解除契約權，自本公司知有解除之原因後，經過一個月不行使而消滅；或自契約訂立
    後，經過二年不行使而消滅。
    本公司通知解除本契約時，如要保人身故、失蹤或居住所不明，通知不能送達時，本公司
    得將該項通知送達受益人。
    【契約的終止】
    第二十七條：要保人得隨時終止本契約。
    前項契約之終止，自本公司收到要保人書面或其他約定方式通知時，開始生效。
    要保人依第一項約定終止本契約時，本公司應從當期已繳保險費扣除按日數比例計算已經
    過期間之保險費後，將其未滿期保險費退還要保人。
    【欠繳保險費的扣除】
    第二十八條：本公司給付各項保險金或退還所繳保險費時，如要保人有欠繳保險費，本公司得先抵銷上
    述欠款後給付其餘額。
    【住院醫療日額之減少】
    第二十九條：要保人在本契約有效期間內，得申請減少「住院醫療日額」，但是減額後的「住院醫療日
    額」，不得低於本保險最低承保「住院醫療日額」，其減少部分依第二十七條契約終止之
    約定處理。
    【不分紅保險單】
    第 三十 條：本保險為不分紅保單，不參加紅利分配，並無紅利給付項目。
    【投保年齡的計算及錯誤的處理】
    第三十一條：要保人在申請投保時，應將被保險人出生年月日在要保書填明。
    被保險人的投保年齡發生錯誤時，依下列規定辦理：
    一、真實投保年齡較本公司保險費率表所載最高年齡為大者，本契約無效，其已繳保險費
    無息退還要保人。
    二、因投保年齡的錯誤，而致溢繳保險費者，本公司無息退還溢繳部分的保險費。但在發
    生保險事故後始發覺且其錯誤發生在本公司者，本公司按原繳保險費與應繳保險費的
    比例提高「住院醫療日額」，而不退還溢繳部分的保險費。
    三、因投保年齡的錯誤，而致短繳保險費者，要保人得補繳短繳的保險費或按照所付的保
    險費與被保險人的真實年齡比例減少「住院醫療日額」。但在發生保險事故後始發覺
    且其錯誤不可歸責於本公司者，要保人不得要求補繳短繳的保險費。
    前項第一款、第二款前段情形，其錯誤原因歸責於本公司者，應加計利息退還保險費，其
    利息按退還保險費當時本公司公告的最低保險單借款利率與民法第二百零三條法定週年利
    率兩者取其大之值計算。

    【保險事故的通知與保險金的申請時間】
    第三十二條：要保人、被保險人或受益人應於知悉本公司應負保險責任之事故後十日內通知本公司，並
    於通知後儘速檢具所需文件向本公司申請給付保險金或依第十九條約定退還所繳保險費。
    本公司應於收齊前項文件後十五日內給付之。但因可歸責於本公司之事由致未在前述約定
    期限內為給付者，應按年利一分加計利息給付。
    【失蹤處理】
    第三十三條：被保險人在本契約有效期間內失蹤者，如經法院宣告死亡時，本公司根據判決內所確定死
    亡時日為準，依第十九條約定退還所繳保險費或給付身故保險金或喪葬費用保險金；如要
    保人或應得之人或受益人能提出證明文件，足以認為被保險人極可能因意外傷害事故而死
    亡者，本公司應依意外傷害事故發生日為準，依第十九條約定退還所繳保險費或給付身故
    保險金或喪葬費用保險金。
    前項情形，本公司退還所繳保險費或給付身故保險金或喪葬費用保險金後，如發現被保險
    人生還時，要保人或應得之人或受益人應將該筆已領之所繳保險費或身故保險金或喪葬費
    用保險金歸還本公司，其間若有應給付保險金之情事發生者，仍應予給付。但有應繳之保
    險費，本公司仍得予以扣除。
    【受益人的指定及變更】
    第三十四條：本契約第六條至第十七條、第二十一條保險金的受益人，為被保險人本人，本公司不受理
    其指定或變更。但被保險人身故時，如有未給付予被保險人之保險金部分，則以本契約身
    故保險金或喪葬費用保險金之受益人為本契約之受益人，如本契約無身故保險金或喪葬費
    用保險金受益人者，則以祝壽保險金受益人為本契約之受益人，如亦無祝壽保險金受益人
    ，則以被保險人之法定繼承人為受益人。
    除前項約定外，要保人得依下列規定指定或變更受益人，並應符合指定或變更當時法令之
    規定：
    一、於訂立本契約時，經被保險人同意指定受益人。
    二、於保險事故發生前經被保險人同意變更受益人，如要保人未將前述變更通知本公司者
    ，不得對抗本公司。
    前項受益人的變更，於要保人檢具申請書及被保險人的同意書（要、被保險人為同一人時
    為申請書或電子申請文件）送達本公司時，本公司應即予批註或發給批註書。
    受益人同時或先於被保險人本人身故，除要保人已另行指定受益人外，以被保險人之法定
    繼承人為本契約受益人。
    法定繼承人之順序及應得保險金之比例適用民法繼承編相關規定。
    【受益人受益權之喪失】
    第三十五條：受益人故意致被保險人於死或雖未致死者，喪失其受益權。
    前項情形，如因該受益人喪失受益權，而致無受益人受領保險金額時，其保險金額作為被
    保險人遺產。如有其他受益人者，喪失受益權之受益人原應得之部份，按其他受益人原約
    定比例分歸其他受益人。

    【「醫療部分」保險金的申領】
    第三十六條：受益人申領本契約第六條至第十七條之「醫療部分」保險金時，應檢具下列文件。
    一、保險金申請書。
    二、保險單或其謄本。
    三、醫療診斷書或住院證明。（但要保人或被保險人為醫師時，不得為被保險人出具診斷
    書或住院證明。）
    四、受益人的身分證明。
    五、申領「加護病房保險金」或「燒燙傷病房保險金」者，須於醫療診斷書列明入、出加
    護病房或燒燙傷病房之日期。
    六、申領「手術醫療保險金」、「住院手術療養保險金」或「門診手術療養保險金」者，
    另需檢具手術證明文件。
    七、申領「治療處置保險金」者，另需檢具治療處置證明文件。
    八、申領「放射線診療保險金」者，另需檢具放射線診療證明文件。
    九、申領「住院前後門診醫療保險金」者，需於醫療診斷書註明門診之日期。
    受益人申領保險金時，本公司於必要時得另經其同意調閱被保險人之就醫相關資料，其一
    切費用由本公司負擔。但不得因此延展保險公司依第三十二條約定應給付之期限。
    【祝壽保險金的申領】
    第三十七條：受益人申領「祝壽保險金」時，應檢具下列文件：
    一、保險單或其謄本。
    二、保險金申請書。
    三、受益人的身分證明。
    【身故保險金或喪葬費用保險金的申領】
    第三十八條：受益人申領「身故保險金」或「喪葬費用保險金」時，應檢具下列文件：
    一、保險單或其謄本。
    二、被保險人死亡證明書或相驗屍體證明書，及除戶戶籍謄本。
    三、保險金申請書。
    四、受益人的身分證明。
    【退還所繳保險費的申請】
    第三十九條：要保人或應得之人依第十九條、第二十三條或第三十三條約定申請退還所繳保險費時，應
    檢具下列文件：
    一、保險單或其謄本。
    二、被保險人死亡證明書或相驗屍體證明書，及除戶戶籍謄本。
    三、申請書。
    四、要保人或應得之人的身分證明。
    【一至六級失能生活扶助保險金的申請】
    第 四十 條：受益人申領「一至六級失能生活扶助保險金」時，應檢具下列文件：

    一、保險金申請書。
    二、保險單或其謄本。
    三、失能診斷書；但必要時本公司得要求提供意外傷害事故證明文件。
    四、受益人之身分證明。
    五、受益人之戶籍謄本或其他生存證明文件。
    受益人於首次申領「一至六級失能生活扶助保險金」時，需檢具前項第一款至第四款之文
    件，以後每次領取「一至六級失能生活扶助保險金」時，應檢送第一、二、四、五款文件
    覆查。
    受益人首次申領「一至六級失能生活扶助保險金」時，必要時本公司得對被保險人的身體
    予以檢驗，並得另經受益人同意調閱被保險人之就醫相關資料，其一切費用由本公司負擔
    。但不因此延展本公司依第三十二條約定應給付之期限。
    【變更住所】
    第四十一條：要保人的住所有變更時，應即以書面或其他約定方式通知本公司。
    要保人不為前項通知者，本公司之各項通知，得以本契約所載要保人之最後住所發送之。
    【時效】
    第四十二條：由本契約所生的權利，自得為請求之日起，經過兩年不行使而消滅。
    【批註】
    第四十三條：本契約內容的變更，或記載事項的增刪，除第三十四條規定者外，應經要保人與本公司雙
    方書面或其他約定方式同意，並由本公司即予批註或發給批註書。
    【管轄法院】
    第四十四條：因本契約涉訟者，同意以要保人住所地地方法院為第一審管轄法院，要保人的住所在中華
    民國境外時，以本公司總公司所在地地方法院為第一審管轄法院。但不得排除消費者保護
    法第四十七條及民事訴訟法第四百三十六條之九小額訴訟管轄法院之適用。

    意欲減退、人格變化等顯著障害；或者麻痺等症狀，雖為輕度，身體能力仍存，但非他人在身邊指
    示，無法遂行其工作者：適用第 3 級。
    （3）中樞神經系統障害，例如無知覺障害之錐體路及錐體外路症狀之輕度麻痺，依影像檢查始可證明之
    輕度腦萎縮、腦波異常等屬之，此等症狀須據專科醫師檢查、診斷之結果審定之。
    （4）中樞神經系統之頹廢症狀如發生於中樞神經系統以外之機能障害，應按其發現部位所定等級定之，
    如障害同時併存時，應綜合其全部症狀擇一等級定之，等級不同者，應按其中較重者定其等級。
    1-2.「平衡機能障害與聽力障害」等級之審定：因頭部損傷引起聽力障害與平衡機能障害同時併存時，
    須綜合其障害狀況定其等級。
    1-3.「外傷性癲癇」障害等級之審定：癲癇發作，同時應重視因反復發作致性格變化而終至失智、人格
    崩壞，即成癲癇性精神病狀態者，依附註 1-1 原則審定之。癲癇症狀之固定時期，應以經專科醫師
    之治療，認為不能期待醫療效果時，及因治療致症狀安定者為準，不論其發作型態，雖經充分治療，
    每週仍有一次以上發作者：適用第 3 級。
    1-4.「眩暈及平衡機能障害」等級之審定：頭部外傷後或因中樞神經系統受損引起之眩暈及平衡機能障
    害，不單由於內耳障害引起，因小腦、腦幹部、額葉等中樞神經系之障害發現者亦不少；為維持生
    命必要之日常生活活動仍有可能，但因高度平衡機能障害，終身不能從事任何工作者：適用第 3 級。
    1-5.「外傷性脊髓障害」等級之審定，依其損傷之程度發現四肢等之運動障害、知覺障害、腸管障害、
    尿路障害、生殖器障害等，依附註 1-1 之原則，綜合其症狀選用合適等級。
    1-6.「一氧化碳中毒後遺症」障害等級之審定：一氧化碳中毒後遺症障害之審定，綜合其所遺諸症候，
    按照附註說明精神、神經障害等級之審定基本原則判斷，定其等級。
    註 2：
    2-1.「視力」之測定：
    （1）應用萬國式視力表以矯正後視力為準，但矯正不能者，得以裸眼視力測定之。
    （2）視力障害之測定，必要時須通過「測盲(Malingering)」檢查。
    2-2.「失明」係指視力永久在萬國式視力表 0.02 以下而言，並包括眼球喪失、摘出、僅能辨明暗或辨眼
    前一公尺以內手動或辨眼前五公分以內指數者。
    2-3.以自傷害之日起經過六個月的治療為判定原則，但眼球摘出等明顯無法復原之情況，不在此限。

    3-1.兩耳聽覺障害程度不同時，應依優耳之聽覺障害審定之。
    3-2.聽覺障害之測定，需用精密聽力計(Audiometer)行之，其平均聽力喪失率以分貝表示之。
    3-3.內耳損傷引起平衡機能障害之審定，準用神經障害所定等級，按其障害之程度審定之。
    註 4：
    4-1.咀嚼機能發生障害，係專指由於牙齒以外之原因（如頰、舌、軟硬口蓋、顎骨、下顎關節等之障害），
    所引起者。食道狹窄、舌異常、咽喉頭支配神經麻痺等引起之吞嚥障害，往往併發咀嚼機能障害，
    故兩項障害合併定為「咀嚼、吞嚥障害」：
    （1）「喪失咀嚼、吞嚥之機能」,係指因器質障害或機能障害，以致不能作咀嚼、吞嚥運動，除流質食物
    外，不能攝取或吞嚥者。
    （2）「咀嚼、吞嚥機能遺存顯著障害」,係指不能充分作咀嚼、吞嚥運動，致除粥、糊、或類似之食物以
    外，不能攝取或吞嚥者。
    4-2.言語機能障害，係指由於牙齒損傷以外之原因引起之構音機能障害、發聲機能障害及綴音機能障害
    等：
    （1）「喪失言語機能障害」，係指後列構成語言之口唇音、齒舌音、口蓋音、喉頭音等之四種語音機能中，
    有三種以上不能構音者。
    （2）「言語機能遺存顯著障害」，係指後列構成語言之口唇音、齒舌音、口蓋音、喉頭音等之四種語言機
    能中，有二種以上不能構音者。
    A.雙唇音：ㄅㄆㄇ(發音部位雙唇者)
    B.唇齒音：ㄈ(發音部位唇齒)
    C.舌尖音：ㄉㄊㄋㄌ(發音部位舌尖與牙齦)

    （1）胸部臟器，係指心臟、心囊、主動脈、氣管、支氣管、肺臟、胸膜及食道。

    尿管造口術)。

    （3）「運動障害」，係指喪失生理運動範圍三分之一以上者。
    7-3.運動限制之測定：
    （1）以各關節之生理運動範圍為基準。機能(運動)障害原因及程度明顯時，採用主動運動之運動範圍，
    如障害程度不明確時，則須由被動運動之可能運動範圍參考決定之。
    （2）經石膏固定患部者，應考慮其癒後恢復之程度，作適宜之決定。
    7-4.上下肢關節名稱及生理運動範圍如說明圖表。
    註 8：
    8-1.「手指永久喪失機能」係指：
    （1）在拇指，中手指節關節或指節間關節，喪失生理運動範圍二分之一以上者。
    （2）在其他各指，中手指節關節，或近位指節間關節，喪失生理運動範圍二分之一以上者。
    （3）拇指或其他各指之末節切斷達二分之一以上者。
