【保險契約的構成】
第一條
本台灣人壽新 LONG 好康手術醫療終身健康保險附約（以下簡稱本附約），係依終身保險主契約（以下簡稱主契約
）要保人申請，並經本公司同意，以主契約之被保險人及其配偶、子女為本附約之被保險人，附加於主契約訂定之
。
本附約保險單條款、附著之要保書、批註及其他約定書，均為本附約的構成部分。
本附約的解釋，應探求契約當事人的真意，不得拘泥於所用的文字；如有疑義時，以作有利於被保險人的解釋為原
則。
【名詞定義】
第二條
本附約所稱名詞定義如下：
一、本附約所稱「疾病」，係指被保險人自本附約生效日起持續有效滿三十日後或復效日（含）起所發生之疾病。
但如被保險人投保時之保險年齡為零歲者，就中央衛生主管機關公告認定「新生兒先天性代謝異常疾病篩檢」
指定項目之相關疾病，不適用前述自本附約生效日起需持續有效滿三十日之限制。
二、本附約所稱「傷害」，係指被保險人於本附約有效期間內，遭受意外傷害事故，因而蒙受之傷害。
三、本附約所稱「意外傷害事故」，係指非由疾病引起之外來突發事故。
四、本附約所稱「醫院」，係指依照醫療法規定領有開業執照並設有病房收治病人之公、私立及醫療法人醫院。
五、本附約所稱「醫師」，係指領有醫師證書而合法執業者，且非要保人、被保險人或受益人本人。
六、本附約所稱「同一次住院」，係指被保險人於本附約有效期間，因同一疾病或傷害，或因此引起之併發症，於
出院後十四日內於同一醫院再次住院時，其各項保險金給付及其限制，視為同一次住院辦理，倘被保險人係於
本附約有效期間屆滿後出院者，本公司就再次住院部分不予給付保險金。
七、本附約所稱「診所」，係指依照醫療法規定領有開業執照之診所。
八、本附約所稱「保險金額」，係指本附約生效時保險單面頁上所載之投保金額，如該金額有所變更時，則以變更
後之「保險金額」為準。
九、本附約所稱「已領醫療保險金倍數」，係指申領第九條至第十五條保險金時，其合計金額除以申領當時「保險
金額」之數值。
十、本附約所稱「累計已領醫療保險金倍數」，係指自本附約生效日起累計之「已領醫療保險金倍數」之數值。
十一、本附約所稱「被保險人」，係指附加本附約之主契約被保險人及其「配偶」、「子女」。
十二、本附約所稱「配偶」，係指於本附約訂定時，主契約被保險人戶籍登記之配偶，並應將其姓名及相關資料載
明於契約中。
十三、本附約所稱「子女」，係指於本附約訂定時，主契約被保險人之未滿二十三歲的親生子女、養子女，並應將
其姓名及相關資料載明於契約中。
【附約撤銷權】
第三條
要保人於保險單送達的翌日起算十日內，得以書面檢同保險單向本公司撤銷本附約。
要保人依前項規定行使本附約撤銷權者，撤銷的效力應自要保人書面之意思表示到達翌日零時起生效，本附約自始
無效，本公司應無息退還要保人所繳保險費；本附約撤銷生效後所發生的保險事故，本公司不負保險責任。但本附
約撤銷生效前，若發生保險事故者，視為未撤銷，本公司仍應依本附約規定負保險責任。
【保險責任的開始及交付保險費】
第四條
本附約如係與主契約同時投保，以主契約保險期間之始時為本附約之始時。如係中途申請附加者，經本公司同意後
，以保險單上所約定的日時為準。
本公司應自同意承保並收取第一期保險費後負保險責任，並應發給保險單作為承保的憑證。
本公司如於同意承保前，預收相當於第一期保險費之金額時，其應負之保險責任，以同意承保時溯自預收相當於第
一期保險費金額時開始。
前項情形，在本公司為同意承保與否之意思表示前發生應予給付之保險事故時，本公司仍負保險責任。
本附約的保險費，應與主契約一併交付。主契約於繳費期滿後，如尚屬有效契約且本附約仍於繳費期間內時，本附
約得按年繳保險費方式，繼續附加於主契約。
【保險範圍】
第五條
被保險人於本附約有效期間內因第二條約定之疾病或傷害接受手術治療、放射線診療或治療處置時，本公司依本附
約約定給付保險金。
【第二期以後保險費的交付、寬限期間及附約效力的停止】
第六條
分期繳納的第二期以後保險費，應照本附約所載交付方法及日期，向本公司所在地或指定地點交付，或由本公司派
員前往收取，並交付本公司開發之憑證。第二期以後分期保險費到期未交付時，年繳或半年繳者，自催告到達翌日
起三十日內為寬限期間；月繳或季繳者，則不另為催告，自保險單所載交付日期之翌日起三十日為寬限期間。
約定以金融機構轉帳或其他方式交付第二期以後的分期保險費者，本公司於知悉未能依此項約定受領保險費時，應
催告要保人交付保險費，自催告到達翌日起三十日內為寬限期間。
逾寬限期間仍未交付者，本附約自寬限期間終了翌日起停止效力。如在寬限期間內發生保險事故時，本公司仍負保
險責任。
本公司依約定催告要保人交付保險費時，其通知應送達於要保人之最後住所或居所，保險費經催告後，應於本公司
營業所交付之。
【保險費的墊繳及附約效力的停止】
第七條
本附約「保險費的墊繳及附約效力的停止」，僅適用附加於主契約保險單條款有「保險費的墊繳及契約效力的停止
」條款之約定者。主契約及本附約保險費，超過主契約寬限期間仍未交付時，應就主契約保險費與本附約保險費之
合計金額準用主契約有關「保險費的墊繳及契約效力的停止」條款之約定辦理。
【本附約效力的恢復】
第八條
本附約停止效力後，要保人得在停效日起二年內，申請復效。但主契約未申請復效者或保險期間屆滿後，本附約亦
不得申請復效。
要保人於停止效力之日起六個月內提出前項復效申請，並經要保人清償保險費扣除停效期間的危險保險費後之餘額
及按保險費之預定利率計算之利息後，自翌日上午零時起，開始恢復其效力。
要保人於停止效力之日起六個月後提出第一項之復效申請者，本公司得於要保人之復效申請送達本公司之日起五日
內要求要保人提供被保險人之可保證明。要保人如未於十日內交齊本公司要求提供之可保證明者，本公司得退回該
次復效之申請。
被保險人之危險程度有重大變更已達拒絕承保程度者，本公司得拒絕其復效。
本公司未於第三項約定期限內要求要保人提供可保證明，或於收齊可保證明後十五日內不為拒絕者，視為同意復效
，並經要保人清償第二項所約定之金額後，自翌日上午零時起，開始恢復其效力。
要保人依第三項提出申請復效者，除有同項後段或第四項之情形外，於交齊可保證明，並清償第二項所約定之金額
後，自翌日上午零時起，開始恢復其效力。
基於保戶服務，本公司於保險契約停止效力後至得申請復效之期限屆滿前三個月，將以書面、電子郵件、簡訊或其
他約定方式擇一通知要保人有行使第一項申請復效之權利，並載明要保人未於第一項約定期限屆滿前恢復保單效力
者，契約效力將自第一項約定期限屆滿之日翌日上午零時起終止，以提醒要保人注意。
本公司已依要保人最後留於本公司之前項聯絡資料發出通知，視為已完成前項之通知。
第一項約定期限屆滿時，本附約效力即行終止。
【手術醫療保險金的給付】
第九條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受手術治療者
，本公司按「保險金額」乘以附表一「手術項目表」中所列該手術項目的倍數，給付「手術醫療保險金」。
被保險人於門診當天或同一次住院期間接受兩項以上手術時，其各項手術醫療保險金應分別計算。但同一次手術中
，於同一手術位置接受兩項器官以上手術時，僅按較高倍數之手術項目給付「手術醫療保險金」。
被保險人所接受的手術，若不在附表一「手術項目表」所載項目且非屬第十七條除外責任範圍內，但屬於事故當時
中央衛生主管機關最新公布之「全民健康保險醫療服務給付項目及支付標準」第二部第二章第七節所載手術項目時
，本公司將比照附表一「手術項目表」內程度相當之手術項目決定給付倍數，但最高不得超過一百倍。
【重大手術慰問保險金的給付】
第十條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受附表二「重
大手術項目表」中所列重大手術項目之一時，本公司除依第九條約定給付「手術醫療保險金」外，另按「保險金額
」乘以附表二「重大手術項目表」中所列該重大手術項目的倍數，給付「重大手術慰問保險金」。
被保險人於門診當天或同一次住院期間接受兩項以上重大手術時，其各項重大手術慰問保險金應分別計算。但同一
次手術中，於同一手術位置接受兩項器官以上手術時，僅按較高倍數之重大手術項目給付「重大手術慰問保險金」
。
【放射線診療保險金的給付】
第十一條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受放射線診療
者，本公司按「保險金額」乘以附表三「放射線診療項目表」中所列該放射線診療項目的倍數，給付「放射線診療
保險金」。若不在附表三上之項目，本公司不負給付責任。
被保險人於門診當天或同一次住院期間接受兩項以上放射線診療時，其各項放射線診療保險金應分別計算。但同一
次放射線診療中，於同一位置接受兩項器官以上放射線診療時，僅按較高倍數之放射線診療項目給付「放射線診療
保險金」。
【治療處置保險金的給付】
第十二條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受治療處置者
，本公司按「保險金額」乘以附表四「治療處置項目表」中所列該治療處置項目的倍數，給付「治療處置保險金」
。若不在附表四上之項目，本公司不負給付責任。
被保險人於門診當天或同一次住院期間接受兩項以上治療處置時，其各項治療處置保險金應分別計算。但同一次治
療處置中，於同一位置接受兩項器官以上治療處置時，僅按較高倍數之治療處置項目給付「治療處置保險金」。
【人工髖關節醫材購置補助保險金的給付】
第十三條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受人工髖關節
置換者，每次置換每側本公司除依第九條至第十二條之約定給付各項保險金外，另按「保險金額」的三十倍，給付
「人工髖關節醫材購置補助保險金」。
【人工膝關節醫材購置補助保險金的給付】
第十四條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受人工膝關節
置換者，每次置換每側本公司除依第九條至第十二條之約定給付各項保險金外，另按「保險金額」的三十倍，給付
「人工膝關節醫材購置補助保險金」。
【人工水晶體醫材購置補助保險金的給付】
第十五條
被保險人於本附約有效期間內，因第二條約定之疾病或傷害，經醫師診斷必須且實際於醫院或診所接受人工水晶體
置換者，每次置換每眼本公司除依第九條至第十二條之約定給付各項保險金外，另按「保險金額」的三十倍，給付
「人工水晶體醫材購置補助保險金」。
【保險金給付的限制】
第十六條
本公司依本附約第九條至第十五條給付之各項保險金，其「累計已領醫療保險金倍數」最高以一千五百倍為限，當
「累計已領醫療保險金倍數」達一千五百倍時，本附約效力即行終止。
【除外責任】
第十七條
被保險人因下列原因所致之疾病或傷害而接受手術治療、放射線診療或治療處置者，本公司不負給付第九條至第十
五條各項保險金的責任。
一、被保險人之故意行為（包括自殺及自殺未遂）。
二、被保險人之犯罪行為。
三、被保險人非法施用防制毒品相關法令所稱之毒品。
被保險人因下列事故接受手術治療、放射線診療或治療處置者，本公司不負給付第九條至第十五條各項保險金的責
任。
一、美容手術、外科整型。但為重建其基本功能所作之必要整型，不在此限。
二、外觀可見之天生畸形。
三、健康檢查、療養、靜養、戒毒、戒酒、護理或養老之非以直接診治病人為目的者。
四、懷孕、流產或分娩及其併發症。但下列情形不在此限：
(一)懷孕相關疾病：
1.子宮外孕。
2.葡萄胎。
3.前置胎盤。
4.胎盤早期剝離。
5.產後大出血。
6.子癲前症。
7.子癇症。
8.萎縮性胚胎。
9.胎兒染色體異常之手術。
(二)因醫療行為所必要之流產，包含：
1.因本人或其配偶患有礙優生之遺傳性、傳染性疾病或精神疾病。
2.因本人或其配偶之四親等以內之血親患有礙優生之遺傳性疾病。
3.有醫學上理由，足以認定懷孕或分娩有招致生命危險或危害身體或精神健康。
4.有醫學上理由，足以認定胎兒有畸型發育之虞。
5.因被強制性交、誘姦或與依法不得結婚者相姦而受孕者。
(三)醫療行為必要之剖腹產，並符合下列情況者：
1.產程遲滯：已進行充足引產，但第一產程之潛伏期過長（經產婦超過 14 小時、初產婦超過 20 小時），或
第一產程之活動期子宮口超過 2 小時仍無進一步擴張，或第二產程超過 2 小時胎頭仍無下降。
2.胎兒窘迫，係指下列情形之一者：
a.在子宮無收縮情況下，胎心音圖顯示每分鐘大於 160 次或少於 100 次且呈持續性者，或胎兒心跳低於
基礎心跳每分鐘 30 次且持續 60 秒以上者。
b.胎兒頭皮酸鹼度檢查 PH 值少於 7.20 者。
3.胎頭骨盆不對稱，係指下列情形之一者：
a.胎頭過大（胎兒頭圍 37 公分以上）。
b.胎兒超音波檢查顯示巨嬰（胎兒體重 4000 公克以上）。
c.骨盆變形、狹窄（骨盆內口 10 公分以下或中骨盆 9.5 公分以下）並經骨盆腔攝影確定者。
d.骨盆腔腫瘤（包括子宮下段之腫瘤，子宮頸之腫瘤及會引起產道壓迫阻塞之骨盆腔腫瘤）致影響生產
者。
4.胎位不正。
5.多胞胎。
6.子宮頸未全開而有臍帶脫落時。
7.兩次（含）以上的死產（懷孕 24 周以上，胎兒體重 560 公克以上）。
8.分娩相關疾病：
a.前置胎盤。
b.子癲前症及子癇症。
c.胎盤早期剝離。
d.早期破水超過 24 小時合併感染現象。
e.母體心肺疾病：
(a)嚴重心律不整，並附心臟科專科醫師診斷證明或心電圖檢查認定須剖腹產 者。
(b)經心臟科採用之心肺功能分級認定為第三或第四級心臟病，並附診斷證明。
(c)嚴重肺氣腫，並附胸腔科專科醫師診斷證明。
五、不孕症、人工受孕或非以治療為目的之避孕及絕育手術。
【告知義務與本附約的解除】
第十八條
要保人或被保險人在訂立本附約時，對於本公司要保書書面詢問的告知事項應據實說明，如有為隱匿或遺漏不為說
明，或為不實的說明，足以變更或減少本公司對於危險的估計者，本公司得解除本附約，其保險事故發生後亦同。
但危險的發生未基於其說明或未說明的事實時，不在此限。惟屬個別被保險人違反前述告知義務者，本公司得就該
被保險人個別部分解除，而不影響其他被保險人於本附約之效力。
前項解除附約權，自本公司知有解除之原因後，經過一個月不行使而消滅；或自本附約訂立後，經過二年不行使而
消滅。
本公司通知解除本附約時，如要保人身故、失蹤或居住所不明，通知不能送達時，本公司得將該項通知送達受益人
。
【附約的終止（一）】
第十九條
要保人得隨時終止個別被保險人投保之本附約。
前項附約之終止，自本公司收到要保人書面或其他約定方式通知時，開始生效。
要保人依第一項約定終止本附約或本附約個別被保險人因身故而致該被保險人於本附約效力終止時，本公司應從當
期已繳保險費扣除按日數比例計算已經過期間之保險費後，將其未到期保險費退還要保人，但附約繳費期滿者，不
在此限。
主契約被保險人身故時，其所附加之本附約的效力即行終止，但其配偶或子女所附加之本附約不在此限。
個別被保險人所投保之本附約除該被保險人已繳費期滿或已達豁免保險費或因保險事故發生且於保險給付當中者
外，有下列情形之一時，其效力持續至該期已繳之保險費期滿後終止：
一、要保人終止主契約時。
二、主契約變更為展期定期保險時。
主契約辦理減額繳清保險或主契約被保險人因非屬身故之保險事故致主契約終止時，本附約應依本公司指定之繳費
方式繳納其應繳交之保險費，以延續本附約之效力。
【附約的終止（二）】
第二十條
被保險人身故或保險年齡達一百零一歲之保單週年日時，本附約效力即行終止。
【投保年齡的計算及錯誤的處理】
第二十一條
被保險人的投保年齡，以足歲計算，但未滿一歲的零數超過六個月者，加算一歲。要保人在申請投保時，應將被保
險人出生年月日在要保書填明。
被保險人的投保年齡發生錯誤時，依下列規定辦理：
一、真實投保年齡較本公司保險費率表所載最高年齡為大者，本附約無效，其已繳保險費無息退還要保人。
二、因投保年齡的錯誤，而致溢繳保險費者，本公司無息退還溢繳部分的保險費。但在發生保險事故後始發覺且其
錯誤發生在本公司者，本公司按原繳保險費與應繳保險費的比例提高保險金額，而不退還溢繳部分的保險費。
三、因投保年齡的錯誤，而致短繳保險費者，要保人得補繳短繳的保險費或按照所付的保險費與被保險人的真實年
齡比例減少保險金額。但在發生保險事故後始發覺且其錯誤不可歸責於本公司者，要保人不得請求補繳短繳的
保險費。
前項第一款、第二款前段情形，其錯誤原因歸責於本公司者，應加計利息退還保險費，其利息按退還保險費當時本
公司公告的最低保險單借款利率與民法第二百零三條法定週年利率兩者取其大之值計算。
【保險事故的通知與保險金的申請時間】
第二十二條
要保人或受益人應於知悉本公司應負保險責任之事故後十日內通知本公司，並於通知後儘速檢具所需文件向本公司
申請給付保險金。
本公司應於收齊前項文件後十五日內給付之。但因可歸責於本公司之事由致未在前述約定期限內為給付者，應按年
利一分加計利息給付。
【受益人】
第二十三條
本附約第九條至第十五條保險金的受益人，為本附約被保險人本人，本公司不受理其指定或變更。
本附約被保險人身故時，如有未給付予被保險人之保險金，則以主契約身故保險金或喪葬費用保險金之受益人為本
附約之受益人，如主契約無身故保險金或喪葬費用保險金受益人者，則以生存保險金或滿期保險金受益人為本附約
之受益人，如亦無生存保險金或滿期保險金受益人，則以被保險人之法定繼承人為受益人。
前項法定繼承人之順序及應得保險金之比例適用民法繼承編相關規定。
【保險金的申領】
第二十四條
受益人申領本附約第九條至第十五條之保險金時，應檢具下列文件。
一、保險金申請書。
二、保險單或其謄本。
三、醫療診斷書或住院證明。
四、申領「手術醫療保險金」、「重大手術慰問保險金」、「人工髖關節醫材購置補助保險金」、「人工膝關節醫
材購置補助保險金」或「人工水晶體醫材購置補助保險金」者，另需檢具手術證明文件。
五、申領「放射線診療保險金」者，另需檢具放射線診療證明文件。
六、申領「治療處置保險金」者，另需檢具治療處置證明文件。
七、受益人的身分證明。
受益人申領保險金時，本公司基於審核保險金之需要，得徵詢其他醫師之醫學專業意見，並得經受益人同意調閱被
保險人之就醫相關資料。因此所生之費用由本公司負擔。但不得因此延展保險公司依第二十二條約定應給付之期限
。
【欠繳保險費的扣除】
第二十五條
本公司給付各項保險金或退還所繳保險費時，如要保人有欠繳保險費，本公司得先抵銷上述欠款後給付其餘額。
【保險金額之減少】
第二十六條
要保人在本附約有效期間內，得申請減少保險金額，但是減額後的保險金額，不得低於本保險最低承保金額，其減
少部分依第十九條附約終止之約定處理。
要保人申請減少保險金額後，本附約保險金的給付以減少後的保險金額為準。
【變更住所】
第二十七條
要保人的住所有變更時，應即以書面通知本公司。
要保人不為前項通知者，本公司之各項通知，得以本附約所載要保人之最後住所發送之。
【時效】
第二十八條
由本附約所生的權利，自得為請求之日起，經過兩年不行使而消滅。
【批註】
第二十九條
本附約內容的變更，或記載事項的增刪，除第二十三條規定者外，應經要保人與本公司雙方書面或其他約定方式同
意，並由本公司即予批註或發給批註書。
【管轄法院】
第三十條
因本附約涉訟者，同意以要保人住所地地方法院為第一審管轄法院，要保人的住所在中華民國境外時，以本公司總
公司所在地地方法院為第一審管轄法院。但不得排除消費者保護法第四十七條及民事訴訟法第四百三十六條之九小
額訴訟管轄法院之適用。
