    【保險契約的構成】
    第 一 條︰本保險單條款、附著之要保書、批註及其他約定書，均為本保險契約（以下簡稱本契約）
    的構成部分。
    本契約的解釋，應探求契約當事人的真意，不得拘泥於所用的文字；如有疑義時，以作有
    利於被保險人的解釋為原則。
    【名詞定義】
    第 二 條：本契約所稱名詞定義如下：
    一、本契約所稱「疾病」係指被保險人自本契約生效日起持續有效滿三十日後或復效日（含
    ）起所發生之疾病。
    二、本契約所稱「傷害」係指被保險人於本契約有效期間內，遭受意外傷害事故，因而蒙受
    之傷害。
    三、本契約所稱「意外傷害事故」係指非由疾病引起之外來突發事故。
    四、本契約所稱「醫院」係指依照醫療法規定領有開業執照並設有病房收治病人之公、私立
    及財團法人醫院。
    五、本契約所稱「住院」係指被保險人經醫師診斷其疾病或傷害必須入住醫院，且正式辦理
    住院手續並確實在醫院接受診療者。
    六、本契約所稱「醫師」係指領有醫師證書，合法執業者，且非要保人或被保險人本人。

    七、本契約所稱「同一次住院」係指被保險人於本契約有效期間，因同一疾病或傷害，或因
    此引起之併發症，於出院後十四日內於同一醫院再次住院時，其各項保險金給付及其限
    制，視為同一次住院辦理。
    八、本契約所稱「住院日數」係指被保險人經正式辦理住院手續並確實在醫院接受診療之日
    數（含入院及出院當日）。
    九、本契約所稱「診所」係指依照醫療法規定僅應門診且設置九張以下觀察病床者。
    十、本契約所稱「重大疾病」，係指被保險人自本契約生效日三十日以後初次經診斷符合下
    列定義之疾病，但因意外傷害事故致成本款第六目及第七目者，不受三十日的限制：
    (一)心肌梗塞：係指因冠狀動脈阻塞而導致部分心肌壞死，其診斷必須同時具備下列
    三條件：
    1.典型之胸痛症狀。
    2.最近心電圖的異常變化，顯示有心肌梗塞者。
    3.心肌酶的異常增高。
    (二)冠狀動脈繞道手術：係指治療冠狀動脈疾病之血管繞道手術，須經心臟內科心導
    管檢查，患者有持續性心肌缺氧造成心絞痛並證實冠狀動脈有狹窄或阻塞情形，
    必須接受冠狀動脈繞道手術者。其他手術不包括在內。
    (三)中風：係指因腦血管的突發病變導致腦血管出血、栓塞、梗塞致永久性神經機能
    障礙者。所謂永久性神經機能障礙者係指事故發生六個月後，經腦神經專科醫師
    認定仍遺留下列殘障之一者：
    1.植物人狀態。
    2.一肢以上機能完全喪失者。所謂機能完全喪失是指三大關節中之
    兩關節以上完
    全僵硬或關節不能隨意識活動。
    3.兩肢以上運動或感覺障礙而無法自理日常生活者。所謂無法自理日常生活者，
    係指食物攝取、大小便始末、穿脫衣服、起居、步行、入浴等，皆不能自己為
    之，經常需要他人加以扶助之狀態。
    4.喪失言語或咀嚼機能者。言語機能的喪失，係指因腦部言語中樞神經的損傷而
    患失語症者。咀嚼機能的喪失，係指由於牙齒以外之原因所引起的機能障礙，
    以致不能做咀嚼運動，除流質食物以外不能攝取之狀態。
    (四)慢性腎衰竭(尿毒症)：係指二個腎臟慢性且不可復原的衰竭而必須接受定期透析
    治療者。
    (五)癌症：係指組織細胞異常增生且有移轉特性之惡性腫瘤或惡性白血球過多症，經
    病理檢驗確定符合行政院衛生署最近刊印之「國際疾病傷害及死因分類標準」歸
    屬於惡性腫瘤之疾病，但下列除外：
    1.第一期何杰金氏病。
    2.慢性淋巴性白血病。
    3.原位癌症。
    4.惡性黑色素瘤以外之皮膚癌。
    (六)癱瘓：係指肢體機能永久完全喪失，包括兩上肢、或兩下肢、或一上肢及一下肢
    ，各有三大關節中之兩關節以上機能永久完全喪失者。所謂機能永久完全喪失係
    指經六個月以後其機能仍完全喪失者。關節機能的喪失係指關節永久完全僵硬或
    關節不能隨意識活動超過六個月以上。上肢三大關節包括肩、肘、腕關節，下肢
    三大關節包括股、膝、踝關節。
    (七)重大器官移植手術：係指接受心臟、肺臟、肝臟、胰臟、腎臟、及骨髓移植。
    十一、本
    契約所稱「專科醫師」，係指經醫師考試及格完成專科醫師訓練，並經中央主管機關
    甄審合格，領有專科醫師證書者。
    十二、本契約所稱「住院醫療日額」係指本契約生效時保險單面頁上所載之投保金額，如該金

    額有所變更時，則以變更後之保險金額為準。
    十三、本契約所稱「年繳化保險費」，係指依「住院醫療日額」乘以本契約訂立時保險費率表
    所載之年繳保險費計算而得之金額。其保險費率表如附表一。
    十四、本契約所稱「繳費年期」，係指本契約訂立時保險單面頁所載之繳費年期。
    十五、本契約所稱「已繳年繳化保險費總和」，於繳費期間內係指「年繳化保險費」乘以當年
    度保單年度數後之金額；於繳費期滿後係指「年繳化保險費」乘以「繳費年期」之金
    額。
    十六、本契約所稱「已領保險金倍數」係指申領第十三條至第二十二條各項保險金時，其合計
    金額除以申領當時「住院醫療日額」之數值。
    十七、本契約所稱「累計已領保險金倍數」係指自契約生效日起累計之「已領保險金倍數
    」之
    數值。
    十八、本契約所稱「醫療部分」係指本契約第十三條至第二十一條之給付項目。
    十九、本契約所稱「重大疾病部分」係指本契約第二十二條至第二十三條之給付項目。
    【契約撤銷權】
    第 三 條︰要保人於保險單送達的翌日起算十日內，得以書面檢同保險單向本公司撤銷本契約。
    要保人依前項規定行使本契約撤銷權者，撤銷的效力應自要保人書面之意思表示到達翌日零
    時起生效，本契約自始無效，本公司應無息退還要保人所繳保險費；本契約撤銷生效後所發
    生的保險事故，本公司不負保險責任。但契約撤銷生效前，若發生保險事故者，視為未撤銷
    ，本公司仍應依本契約規定負保險責任。
    【保險責任的開始及交付保險費】
    第 四 條︰本公司應自同意承保並收取第一期保險費後負保險責任，並應發給保險單作為承保的憑
    證。
    本公司如於同意承保前，預收相當於第一期保險費之金額時，其應負之保險責任，以同意承
    保時溯自預收相當於第一期保險費金額時開始。
    前項情形，在本公司為同意承保與否之意思表示前發生應予給付之保險事故時，本公司仍負
    保險責任。
    【保險範圍】
    第 五 條︰被保險人於本契約有效期間內身故、全殘廢、因第二條約定之疾病或傷害住院診療時、醫
    師診斷必須且實際於登記合格之醫院或診所接受手術治療者、經醫院診斷確定罹患「重大
    疾病」者或於保險年齡達一○一歲之保單週年日時仍生存者，本公司依照本契約約定給付
    保險金。
    【第二期以後保險費的交付、寬限期間及契約效力的停止】
    第 六 條︰分期繳納的第二期以後保險費，應照本契約所載交付方法及日期，向本公司所在地或指定
    地點交付，或由本公司派員前往收取，並交付本公司開發之憑證。第二期以後分期保險費
    到期未交付時，年
    繳或半年繳者，自催告到達翌日起三十日內為寬限期間；月繳或季繳者
    ，則不另為催告，自保險單所載交付日期之翌日起三十日為寬限期間。
    約定以金融機構轉帳或其他方式交付第二期以後的分期保險費者，本公司於知悉未能依此
    項約定受領保險費時，應催告要保人交付保險費，自催告到達翌日起三十日內為寬限期
    間。
    逾寬限期間仍未交付者，本契約自寬限期間終了翌日起停止效力。如在寬限期間內發生保
    險事故時，本公司仍負保險責任。
    本公司依第二項約定催告要保人交付保險費時，其通知應送達於要保人，或負有交付保險
    費義務之人之最後住所或居所，保險費經催告後，應於本公司營業所交付之。

    【保險費的墊繳及契約效力的停止】
    第 七 條︰要保人得於要保書或繳費寬限期間終了前以書面聲明，第二期以後的分期保險費於超過寬
    限期間仍未交付者，本公司應以本契約及其附約當時的保單價值準備金（如有保險單借款
    者，以扣除其借款本息後的餘額）自動墊繳本契約及其附約應繳的保險費及利息，使本契
    約繼續有效。但要保人亦得於次一墊繳日前以書面通知本公司停止保險費的自動墊繳。墊
    繳保險費的利息，自寬限期間終了的翌日起，按墊繳當時本公司公告的保險費自動墊繳利
    率且不超過本保單辦理保險單借款的利率計算，並應於墊繳日後之翌日起開始償付利息；
    但要保人自應償付利息之日起，未付利息已逾一年以上而經催告後仍未償付者，本公司得
    將其利息滾入墊繳保險費後再行計息。
    前項每次墊繳保險費的本息，本公司應即出具憑證交予要保人，並於憑證上載明墊繳之本
    息與本契約及其附約保單價值準備金之餘額。保單價值準備金之餘額不足墊繳一日的保險
    費且經催告到達後屆三十日仍不交付時，本契約效力停止。
    第一項所稱分期保險費係指本契約及其附約保險費之合計金額。
    【本契約效力的恢復】
    第 八 條︰本契約停止效力後，要保人得在停效日起二年內申請復效。但保險期間屆滿後不得申請復
    效。
    要保人於停止效力之日起六個月內提出前項
    復效申請，並經要保人清償保險費扣除停效期
    間的危險保險費後之餘額及按本契約辦理保險單借款之利率計算之利息後，自翌日上午零
    時起，開始恢復其效力。
    要保人於停止效力之日起六個月後提出第一項之復效申請者，本公司得於要保人之復效申
    請送達本公司之日起五日內要求要保人提供被保險人之可保證明。要保人如未於十日內交
    齊本公司要求提供之可保證明者，本公司得退回該次復效之申請。
    被保險人之危險程度有重大變更已達拒絕承保程度者，本公司得拒絕其復效。
    本公司未於第三項約定期限內要求要保人提供可保證明，或於收齊可保證明後十五日內不
    為拒絕者，視為同意復效，並經要保人清償第二項所約定之金額後，自翌日上午零時起，
    開始恢復其效力。
    要保人依第三項提出申請復效者，除有同項後段或第四項之情形外，於交齊可保證明，並
    清償第二項所約定之金額後，自翌日上午零時起，開始恢復其效力。
    本契約因第七條第二項或第四十一條約定停止效力而申請復效者，除復效程序依前六項約
    定辦理外，要保人清償保險單借款本息與墊繳保險費及其利息，其未償餘額合計不得逾依
    第四十一條第一項約定之保險單借款可借金額上限。
    第一項約定期限屆滿時，本契約效力即行終止，本契約若累積達有保單價值準備金，而要
    保人未申請墊繳保險費或變更契
    約內容時，本公司應主動退還剩餘之保單價值準備金。
    【告知義務與本契約的解除】
    第 九 條︰要保人或被保險人在訂立本契約時，對於本公司要保書書面詢問的告知事項應據實說明，
    如有故意隱匿，或因過失遺漏或為不實的說明，足以變更或減少本公司對於危險的估計者
    ，本公司得解除契約，其保險事故發生後亦同。但危險的發生未基於其說明或未說明的事
    實時，不在此限。
    前項解除契約權，自本公司知有解除之原因後，經過一個月不行使而消滅；或自契約訂立
    後，經過二年不行使而消滅。
    本公司通知解除本契約時，如要保人身故、居住所不明，通知不能送達時，本公司得將該
    項通知送達受益人。
    【契約的終止】

    第 十 條︰要保人得隨時終止本契約。
    前項契約之終止，自本公司收到要保人書面通知時，開始生效。
    要保人保險費已付足達一年以上或繳費累積達有保單價值準備金而終止契約時，本公司應於
    接到通知後一個月內償付解約金。逾期本公司應按年利一分加計利息給付。本契約歷年解約
    金額如保險單面頁附表。
    【保險事故的通知與保險金的申請時間】
    第十一條︰要保人或受益人應於知悉本公司應負保險責任之事故後十日內通知本公司，並於通知後儘
    速檢具所需文件向本公司申請給付保險金。
    本公司應於收齊前項文件後十五日內給付之。但因可歸責於本公司之事由致未在前述約定
    期限內為給付者，應按年利一分加計利息給付。
    【失蹤處理】
    第十二條︰被保險人在本契約有效期間內失蹤者，如經法院宣告死亡時，本公司根據判決內所確定死
    亡時日為準，依第二十四條約定給付身故保險金或喪葬費用保險金；如要保人或受益人能提
    出證明文件，足以認為被保險人極可能因意外傷害事故而死亡者，本公司應依意外傷害事故
    發生日為準，依第二十四條約定給付身故保險金或喪葬費用保險金。
    前項情形，本公司給付身故保險金後，如發現被保險人生還時，受益人應將該筆已領之身故
    保險金歸還本公司，其間若有應給付保險金之情事發生者，仍應予給付。但有應繳之保險費
    ，本公司仍得予以扣除。
    【住院醫療保險金的給付】
    第十三條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，本公司按被保險
    人於同一次住院期間之實際住院日數及「住院醫療日額」，依下表給付「住院醫療保險
    金
    」：
    同一次住院期間之實際住院日數 每日給付金額
    自第一日起至第三十日部分 住院醫療日額×1
    自第三十一日起至第九十日部分 住院醫療日額×2
    自第九十一日以後 住院醫療日額×3
    【加護病房保險金的給付】
    第十四條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害而進住加護病房診療時，本公
    司除依第十三條約定給付「住院醫療保險金」外，另按「住院醫療日額」的二倍乘以該被保
    險人實際進住加護病房之日數(含轉進及轉出當日)，給付「加護病房保險金」。
    【燒燙傷病房保險金的給付】
    第十五條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害而進住燒燙傷病房診療時，本
    公司除依第十三條約定給付「住院醫療保險金」外，另按「住院醫療日額」的三倍乘以該被
    保險人實際進住燒燙傷病房之日數(含轉進及轉出當日)，給付「燒燙傷病房保險金」。
    【住院療養保險金的給付】
    第十六條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，本公司除依第十
    三條約定給付「住院醫療保險金」外，另按「住院醫療日額」的百分之五十乘以該被保險人
    於同一次住院期間之實際住院日數，給付「住院療養保險金」。
    【手術醫療保險金的給付】
    第十七條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害經醫師診斷必須且實際於登記
    合格之醫院或診所接受手術治療者，本公司按「住院醫療日額」乘以附表二「手術項目表」

    中所列該手術項目的倍數，給付「手術醫療保險金」。
    同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官手術時，或同一部
    位接受兩次或兩次以上手術時，僅按較高倍數之手術項目給付「手術醫療保險金」。
    被保險人所接受的手術，若不在附表二「手術項目表」所載項目且非屬第三十三條除外責任
    範圍內，但屬於事故當時行政院衛生署最新公布之「全民健康保險醫療費用支付標準」第二
    部第二章第七節所載手術項目時，比照該支付點數計算給付倍數，每滿一千點為一倍，支付
    點數換算後少於一倍者不予給付，但最高不得超過五十倍。
    【住院前後門診醫療保險金的給付】
    第十八條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，於其住院診療的
    前十四日內及出院後十四日內，因與住院同一疾病或傷害而接受門診診療者，本公司按「住
    院醫療日額」的百分之五十乘以實際門診次數，給付「住院前後門診醫療保險金」。但每日
    門診以給付一次為限。
    【急診醫療保險金的給付】
    第十九條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，於辦理住院手續
    前的二十四小時內，因與住院同一疾病或傷害而辦理住院前急診者，本公司按「住院醫療日
    額」的一點五倍給付「急診醫療保險金」。
    【緊急醫療轉送保險金的給付】
    第二十條︰被保險人於本契約有效期間內，因第二條約定之疾病或傷害住院診療時，於其住院醫療期
    間(含住院前)以救護車緊急醫療轉送者，本公司按「住院醫療日額」的二倍給付「緊急醫療
    轉送保險金」。
    【無理賠增額保險金的給付】
    第二十一條︰受益人於申領第十三條至第二十條之各項保險金時，如於本次保險事故發生日之前二個
    保單年度，未依第十三條至第二十條之約定申請各項保險金且持續有效時，本公司除依第
    十三條至第二十條約定給付各項保險金，另按第十三條至第二十條各項保險金給付合計金
    額的百分之二十，給付「無理賠增額保險金」。
    受益人於申領第十三條至第二十條之各項保險金時，如於本次保險事故發生日之前五個保
    單年度，未依第十三條至第二十條之約定申請各項保險金且持續有效時，則前項「百分之
    二十」提高為「百分之五十」，給付「無理賠增額保險金」。
    【重大疾病保險金的給付】
    第二十二條︰被保險人於本契約有效期間內經醫院診斷確定罹患本契約第二條約定之「重大疾病」者
    ，本公司按「住院醫療日額」的二百倍給付「重大疾病保險金」，惟「重大疾病保險金」
    之給付以一次為限。
    【豁免保險費】
    第二十三條︰被保險人於本契約有效期間內經醫院診斷確定罹患本契約第二條約定之「重大疾病」者
    ，自該被保險人診斷確定罹患「重大疾病」之日起，豁免以後各期未到期保險費，本契約
    繼續有效。
    前項所約定之豁免保險費僅適用於本主契約，不包括其他附加於本契約及併同出單之任何
    保險契約。
    【身故保險金或喪葬費用保險金的給付】
    第二十四條︰被保險人於本契約有效期間內身故時，本公司依保險事故發生時下列三款方式計算所得

    金額之最高者給付「身故保險金」。本公司依約定給付「身故保險金」後，本契約效力即
    行終止。
    一、「住院醫療日額」的五百倍。
    二、「住院醫療日額」的八百倍扣除「住院醫療日額」乘以「累計已領保險金倍數」後
    之金額。
    三、「已繳年繳化保險費總和」扣除「住院醫療日額」乘以「累計已領保險金倍數」後
    之金額。
    訂立本契約時，以精神障礙或其他心智缺陷，致不能辨識其行為或欠缺依其辨識而行為之
    能力者為被保險人，其身故保險金均變更為喪葬費用保險金。
    前項被保險人於民國九十九年二月三日（含）以後所投保之喪葬費用保險金額總和（不限
    本公司），不得超過訂立本契約時遺產及贈與稅法第十七條有關遺產稅喪葬費扣除額之半
    數，其超過部分本公司不負給付責任，本公司並應無息退還該超過部分之已繳保險費。
    前項情形，如要保人向二家（含）以上保險公司投保，或向同一保險公司投保數個保險契
    (附)約，且其投保之喪葬費用保險金額合計超過前項所定之限額者，本公司於所承保之喪
    葬費用金額範圍內，依各要保書所載之要保時間先後，依約給付喪葬費用保險金至前項喪
    葬費用額度上限為止，如有二家以上保險公司之保險契約要保時間相同或無法區分其要保
    時間之先後者，各該保險公司應依其喪葬費用保險金額與扣除要保時間在先之保險公司應
    理賠之金額後所餘之限額比例分擔其責任。
    【全殘廢保險金的給付】
    第二十五條︰被保險人於本契約有效期間內，致成附表三「全殘廢項目表」中所列全殘廢項目之一時
    ，本公司按下列三款方式計算所得金額之最高者給付「全殘廢保險金」。本公司依約定給
    付「全殘廢保險金」後，本契約效力即行終止。
    一、「住院醫療日額」的五百倍。
    二、「住院醫療日額」的八百倍扣除「住院醫療日額」乘以「累計已領保險金倍數」後之
    金額。
    三、「已繳年繳化保險費總和」扣除「住院醫療日額」乘以「累計已領保險金倍數」後之
    金額。
    【祝壽保險金的給付】
    第二十六條︰被保險人於保險年齡達一○一歲之保單週年日時仍生存且本契約仍屬有效者，本公司按
    下列三款方式計算所得金額之最高者給付「祝壽保險金」。本公司依約定給付「祝壽保險
    金」後，本契約效力即行終止。
    一、「住院醫療日額」的五百倍。
    二、「住院醫療日額」的八百倍扣除「住院醫療日額」乘以「累計已領保險金倍數」後
    之金額。
    三、「已繳年繳化保險費總和」扣除「住院醫療日額」乘以「累計已領保險金倍數」後之
    金額。
    【保險金給付的限制】
    第二十七條︰本公司依本契約第十三條至第二十條給付之各項保險金，其累計最高以「住院醫療日
    額」的三千倍為限。
    被保險人依本契約第十三條至第二十條累計已領取之各項保險金總額達「住院醫療日額」
    的三千倍時，本公司不再給付第十三條至第二十一條之各項保險金。
    【「醫療部分」保險金的申領
    】
    第二十八條︰受益人申領第十三條至第二十一條之「醫療部分」保險金時，應檢具下列文件：
    5D0-9
    一、保險金申請書。
    二、醫療診斷書或住院證明。（但要保人或被保險人為醫師時，不得為被保險人出具診
    斷書或住院證明。）
    三、申領「加護病房保險金」或「燒燙傷病房保險金」者，須列明入、出加護病房或燒
    燙傷病房之日期。
    四、申領「手術醫療保險金」者，需檢具手術證明文件。
    五、申領「住院前後門診醫療保險金」者，需註明門診之日期。
    六、申領「急診醫療保險金」者，需檢具急診診斷證明文件。
    七、申領「緊急醫療轉送保險金」者，需檢具以救護車緊急醫療轉送之證明文件（包含
    醫院或專營救護車業者所開立之收據）。
    受益人申領保險金時，本公司於必要時得另經其同意調閱被保險人之就醫相關資料，其一
    切費用由本公司負擔。但不因此延展保險公司依第十一條約定應給付之期限。
    【「重大疾病部分」保險金的申領】
    第二十九條︰受益人申領第二十二條或申請第二十三條「重大疾病部分」保險金時，應檢具下列文件
    ：
    一、保險單或其謄本。
    二、保險金申請書。
    三、醫師診斷書。如有接受外科手術者，請檢具外科手術證明文件。（但要保人或被保險
    人為醫師時，不得為被保險人出具診斷書及證明書）。
    四、相關檢驗或病理切片報告。
    受益人申
    領或申請「重大疾病部分」保險金時，本公司得對被保險人的身體予以檢驗，必
    要時並得另經受益人同意調閱被保險人之就醫相關資料，其一切費用由本公司負擔。但不
    因此延展保險公司依第十一條約定應給付之期限。
    【祝壽保險金的申領】
    第 三十 條︰受益人申領「祝壽保險金」時，應檢具下列文件：
    一、保險單或其謄本。
    二、保險金申請書。
    三、受益人的身分證明。
    【身故保險金或喪葬費用保險金的申領】
    第三十一條︰受益人申領「身故保險金」或「喪葬費用保險金」時，應檢具下列文件：
    一、保險單或其謄本。
    二、被保險人死亡證明書或相驗屍體證明書，及除戶戶籍謄本。
    三、保險金申請書。
    四、受益人的身分證明。
    【全殘廢保險金的申領】
    第三十二條︰受益人申領「全殘廢保險金」時，應檢具下列文件：
    一、保險單或其謄本。
    二、殘廢診斷書。
    三、保險金申請書。
    四、受益人的身分證明。
    受益人申領全殘廢之保險金時，本公司得對被保險人的身體予以檢驗，必要時並得另經受
    益人同意調閱被保險人之就醫相關資料，其一切費用由本公司負擔。但不因此延展保險公
    司依第十一條約定應給付之期限。
    5D0-10
    【「醫療部分」之除外責任】
    第三十三條︰被保險人因下列原因所致之疾病或傷害而住院診療或接受手術治療者，本公司不負給付
    第十三條至第二十一條各項保險金的責任。
    一、被保險人之故意行為（包括自殺及自殺未遂）。
    二、被保險人之犯罪行為。
    三、被保險人非法施用防制毒品相關法令所稱之毒品。
    被保險人因下列事故而住院診療或接受手術治療者，本公司不負給付第十三條至第二十一
    條各項保險金的責任。
    一、美容手術、外科整型。但為重建其基本功能所作之必要整型，不在此限。
    二、外觀可見之天生畸形。
    三、健康檢查、療養、靜養、戒毒、戒酒、護理或養老之非以直接診治病人為目的者。
    四、懷孕、流產或分娩及其併發症。但下列情形不在此限：
    （一）懷孕相關疾病：
    1.子宮外孕。
    2.葡萄胎。
    3.前置胎盤。
    4.胎盤早期剝離。
    5.產後大出血。
    6.子癲前症。
    7.子癇症。
    8.萎縮性胚胎。
    9.胎兒染色體異常之手術。
    （二）因醫療行為所必要之流產，包含：
    1.因本人或其配偶患有礙優生之遺傳性、傳染性疾病或精神疾病。
    2.因本人或其配偶之四親等以內之血親患有礙優生之遺傳性疾病。
    3.有醫學上理由，足以認定懷孕或分娩有招致生命危險或危害身體或精神健康。
    4.有醫學上理由，足以認定胎兒有畸型發育之虞。
    5.因被強制性交、誘姦或與依法不得結婚者相姦而受孕者。
    （三）醫療行為必要之剖腹產，並符合下列情況者：
    1.產程遲滯：已進行充足引產，但第一產程之潛伏期過長（經產婦超過14小時、初
    產婦超過20小時），或第一產程之活動期子宮口超過2小時仍無進一步擴張，或
    第二產程超過2小時胎頭仍無下降。
    2.胎兒窘迫，係指下列情形之一者：
    a.在子宮無收縮情況下，胎心音圖顯示每分鐘大於160次或少於100次且呈持續
    性者，或胎兒心跳低於基礎心跳每分鐘30次且持續60秒以上者。
    b.胎兒頭皮酸鹼度檢查PH值少於7.20者。
    3.胎頭骨盆不對稱，係指下列情形之一者：
    a.胎頭過大（胎兒頭圍37公分以上）。
    b.胎兒超音波檢查顯示巨嬰（胎兒體重4000公克以上）。
    c.骨盆變形、狹窄（骨盆內口10公分以下或中骨盆9.5公分以下）並經骨盆腔攝
    影確定者。
    d.骨盆腔腫瘤（包括子宮下段之腫瘤，子宮頸之腫瘤及會引起產道壓迫阻塞之
    骨盆腔腫瘤）致影響生產者。
    4.胎位不正。
    5.多胞胎。
    5D0-11
    6.子宮頸未全開而有臍帶脫落時。
    7.兩次（含）以上的死產（懷孕24周以上，胎兒體重560公克以上）。
    8.分娩相關疾病：
    a.前置胎盤。
    b.子癲前症及子癇症。
    c.胎盤早期剝離。
    d.早期破水超過24小時合併感染現象。
    e.母體心肺疾病：
    （a）嚴重心律不整，並附心臟科專科醫師診斷證明或心電圖檢查認定須剖腹產
    者。
    （b）經心臟科採用之心肺功能分級認定為第三或第四級心臟病，並附診斷證
    明。
    （c）嚴重肺氣腫，並附胸腔科專科醫師診斷證明。
    五、不孕症、人工受孕或非以治療為目的之避孕及絕育手術。
    【「重大疾病部分」之除外責任】
    第三十四條︰被保險人因下列原因所致之重大疾病者，本公司不負給付「重大疾病部分」保險金的責
    任。
    一、被保險人之故意行為（包括自殺及自殺未遂）。
    二、被保險人之犯罪行為。
    三、被保險人非法施用防制毒品相關法令所稱之毒品。
    【身故保險金或喪葬費用保險金及全殘廢保險金之除外責任】
    第三十五條︰有下列情形之一者，本公司不負給付第二十四條及第二十五條保險金的責任。
    一、要保人故意致被保險人於死。
    二、被保險人故意自殺或自成全殘廢。但自本契約訂立或復效之日起二年後故意自殺致
    死者，本公司仍負給付身故保險金或喪葬費用保險金之責任。
    三、被保險人因犯罪處死或拒捕或越獄致死或全殘廢。
    前項第一款及第三十六條情形致被保險人全殘廢時，本公司按第二十五條的約定給付全
    殘廢保險金。
    因第一項各款情形而免給付保險金者，本契約累積達有保單價值準備金時，依照約定給
    付保單價值準備金予應得之人。
    【受益人受益權之喪失】
    第三十六條︰受益人故意致被保險人於死或雖未致死者，喪失其受益權。
    前項情形，如因該受益人喪失受益權，而致無受益人受領保險金額時，其保險金額作為被
    保險人遺產。如有其他受益人者，喪失受益權之受益人原應得之部份，按其他受益人原約
    定比例分歸其他受益人。
    【欠繳保險費或未還款項的扣除】
    第三十七條︰本公司給付各項保險金、解約金或返還保單價值準備金時，如要保人有欠繳保險費（包
    括經本公司墊繳的保險費）或保險單借款未還清者，本公司得先抵銷上述欠款及扣除其應
    付利息後給付其餘額。
    【住院醫療日額之減少】
    第三十八條︰要保人在本契約有效期間內，得申請減少「住院醫療日額」，但是減額後的「住院醫療
    日額」，不得低於本保險最低承保「住院醫療日額」，其減少部分依第十條契約終止之約
    定處理。
    5D0-12
    【減額繳清保險】
    第三十九條︰要保人於繳費期間內繳足保險費累積達有保單價值準備金時，要保人得以當時保單價值
    準備金扣除營業費用後的數額作為一次繳清的躉繳保險費，向本公司申請改保同類保險的
    「減額繳清保險」，其「住院醫療日額」如保險單面頁附表。要保人變更為「減額繳清保
    險」後，不必再繼續繳保險費，本契約繼續有效。其保險範圍與原契約同，但「住院醫療
    日額」以減額繳清保險金額為準，其「年繳化保險費」則依減額繳清後之「住院醫療日
    額」所對應保險費計算之。
    要保人選擇改為「減額繳清保險」當時，倘有保險單借款或欠繳、墊繳保險費的情形，本
    公司將以保單價值準備金扣除欠繳保險費或借款本息或墊繳保險費本息及營業費用後的淨
    額辦理。
    本條營業費用以原「住院醫療日額」五百倍之百分之一或以其保單價值準備金與其解約金
    之差額，兩者較小者為限。
    【展期定期保險】
    第 四十 條︰要保人於繳費期間內繳足保險費累積達有保單價值準備金時，要保人得以當時保單價值
    準備金扣除營業費用後的數額作為一次繳清的躉繳保險費，向本公司申請改為「展期定期
    保險」，其保險金額為申請當時「住院醫療日額」五百倍扣除保險單借款本息或墊繳保險
    費本息後之餘額。要保人不必再繼續繳保險費，其展延期間如保險單面頁附表，但不得超
    過被保險人保險年齡達一○一歲之保單週年日前一日。
    要保人依前項約定辦理展期定期保險後，本契約第十三條至第二十三條及第二十六條即不
    再適用，被保險人於展延期間內發生第二十四條或第二十五條之保險事故時，其身故保險
    金或喪葬費用保險金、全殘廢保險金依計算所得金額取最高者之方式不再適用，本公司按
    前項變更後之保險金額給付保險金後，本契約即行終止。
    如當時保單價值準備金扣除營業費用後的數額超過展期定期保險至被保險人保險年齡達一
    ○一歲之保單週年日前一日所需的躉繳保險費時，要保人得以其超過款額作為一次躉繳保
    險費，購買於本契約繳費期滿時給付的「繳清生存保險」，其保險金額如保險單面頁附
    表。
    要保人選擇改為「展期定期保險」當時，倘有保險單借款或欠繳、墊繳保險費的情形，本
    公司將以保單價值準備金扣除欠繳保險費或借款本息或墊繳保險費本息及營業費用後的淨
    額辦理。
    本條營業費用以申請當時「住院醫療日額」五百倍之百分之一或以其保單價值準備金與其
    解約金之差額，兩者較小者為限。
    【保險單借款及契約效力的停止】
    第四十一條︰要保人繳足保險費累積達有保單價值準備金時，要保人得向本公司申請保險單借款，其
    可借金額上限為借款當日保單價值準備金之八十％，惟繳費期滿後為九十％。本公司於接
    到要保人借款通知後，於一個月內貸給可得質借之金額。未償還之借款本息，超過其保單
    價值準備金時，本契約效力即行停止。但本公司應於效力停止日之三十日前以書面通知要
    保人。
    本公司未依前項規定為通知時，於本公司以書面通知要保人返還借款本息之日起三十日內
    要保人未返還者，本契約之效力自該三十日之次日起停止。
    本契約因前二項約定停止效力時，其恢復效力之申請依本契約第八條約定辦理。
    【不分紅保險單】
    第四十二條︰本保險為不分紅保單，不參加紅利分配，並無紅利給付項目。
    【投保年齡的計算及錯誤的處理】
    5D0-13
    第四十三條︰要保人在申請投保時，應將被保險人出生年月日在要保書填明。被保險人的投保年齡，
    以足歲計算，但未滿一歲的零數超過六個月者，加算一歲。
    被保險人的投保年齡發生錯誤時，依下列規定辦理：
    一、因投保年齡的錯誤，而致溢繳保險費者，本公司無息退還溢繳部分的保險費。但在發
    生保險事故後始發覺且其錯誤發生在本公司者，本公司按原繳保險費與應繳保險費的
    比例提高「住院醫療日額」，而不退還溢繳部分的保險費。
    二、因投保年齡的錯誤，而致短繳保險費者，應補足其差額。但在發生保險事故後始發覺
    且其錯誤並非發生在本公司者，本公司得按原繳保險費與應繳保險費的比例減少「住
    院醫療日額」，而不得請求補足差額。
    前項第一款前段情形，其錯誤原因歸責於本公司者，應加計利息退還保險費，其利息按退
    還保險費當時本保單辦理保險單借款之利率與民法第二百零三條法定週年利率兩者取其大
    者計算。
    【受益人的指定及變更】
    第四十四條︰全殘廢保險金及第十三條至第二十二條保險金的受益人，為被保險人本人，本公司不受
    理其指定或變更。但被保險人身故時，如有未給付予被保險人之保險金部分，則以本契約
    身故保險金或喪葬費用保險金之受益人為本契約之受益人，如本契約無身故保險金或喪葬
    費用保險金受益人者，則以祝壽保險金受益人為本契約之受益人，如亦無祝壽保險金受益
    人，則以被保險人之法定繼承人為受益人。
    除前項約定外，要保人得依下列規定指定或變更受益人：
    一、於訂立本契約時，經被保險人同意指定受益人。
    二、於保險事故發生前經被保險人同意變更受益人，如要保人未將前述變更通知本公司者
    ，不得對抗本公司。
    前項受益人的變更，於要保人檢具申請書及被保險人的同意書送達本公司時，本公司應即
    予批註或發給批註書。
    受益人同時或先於被保險人本人身故，除要保人已另行指定受益人外，以被保險人之法定
    繼承人為本契約受益人。
    法定繼承人之順序及應得保險金
    之比例適用民法繼承編相關規定。
    【變更住所】
    第四十五條︰要保人的住所有變更時，應即以書面通知本公司。
    要保人不為前項通知者，本公司之各項通知，得以本契約所載要保人之最後住所發送之。
    【時效】
    第四十六條︰由本契約所生的權利，自得為請求之日起，經過兩年不行使而消滅。
    【批註】
    第四十七條︰本契約內容的變更，或記載事項的增刪，除第四十四條規定者外，應經要保人與本公司
    雙方書面同意，並由本公司即予批註或發給批註書。
    【管轄法院】
    第四十八條︰因本契約涉訟者，同意以要保人住所地地方法院為第一審管轄法院，要保人的住所在中
    華民國境外時，以本公司總公司所在地地方法院為第一審管轄法院。但不得排除消費者
    保護法第四十七條及民事訴訟法第四百三十六條之九小額訴訟管轄法院之適用。

    一、雙目均失明者。（註一）
    二、兩上肢腕關節缺失者或兩下肢足踝關節缺失者。
    三、一上肢腕關節及一下肢足踝關節缺失者。
    四、一目失明及一上肢腕關節缺失者或一目失明及一下肢足踝關節缺失者。
    五、永久喪失咀嚼（註二）或言語（註三）之機能者。
    六、四肢機能永久完全喪失者。（註四）
    七、中樞神經系統機能遺存極度障害或胸、腹部臟器機能遺存極度障害，終身不能從事任何工
    作，經常需醫療護理或專人周密照護者。（註五）
    註一：失明的認定
    （1）視力的測定，依據萬國式視力表，兩眼個別依矯正視力測定之。
    （2）失明係指視力永久在萬國式視力表零點零二以下而言。
    （3）以自傷害之日起經過六個月的治療為判定原則，但眼球摘出等明顯無法復原之情況，不在此限。
    註二：喪失咀嚼之機能係指因器質障害或機能障害，以致不能作咀嚼運動，除流質食物外，不能攝取

    者。
    註三：喪失言語之機能係指後列構成語言之口唇音、齒舌音、口蓋音、喉頭音等之四種語音機能中，
    有三種以上不能構音者。
    註四：所謂機能永久完全喪失係指經六個月以後其機能仍完全喪失者。
    註五：因重度神經障害，為維持生命必要之日常生活活動，全須他人扶助者。
    上述「為維持生命必要之日常生活活動」係指食物攝取、大小便始末、穿脫衣服、起居、步行、
    入浴等。
